Expenses and proceeds of litigation. Where a suit or suits have been brought by Licensee, Licensee shall maintain the litigation at its own expense and shall keep any judgments and awards arising from these suits expecting that portion of the judgments attributable to royalties from the infringer shall be divided equally between Licensor and Licensee after deducting any and all expenses of such suits; provided, however, Licensor shall not be entitled to receive more under this provision than if the infringer had been licensed by Licensee.

Expenses and proceeds of litigation. Recoveries or reimbursements from actions commenced pursuant to this Article 11 shall first be applied to reimburse the Licensee and the Licensor for litigation costs. Any remaining recovering or reimbursements shall be kept wholly by the Licensee if the Licensor did not join the action as a party, and equally by the Licensee and the Licensor if the Licensor elected to join the action as a party.
Expenses and proceeds of litigation. Each party shall recover its respective actual out-of-pocket expenses, or equitable proportions thereof, associated with any litigation or settlement contemplated hereby from any recovery made by that party. Licensee shall own improvements by the inventors. Licensee shall pay future costs of preparation, filling, prosecuting and maintenance of patents and applications on patentable improvements made by inventors. Licensee shall retain all rights to future improvements by the inventors as expressed in this agreement for current assets and rights described herein.
