EXPIRED PRODUCTS. In case of expiry of the products 50% of products cost (taxable invoice value- means the cost before tax) will be borne by the franchisee and remaining 50% will be borne by the franchisee.
EXPIRED PRODUCTS. Distributor shall not sell any Products beyond their stated expiration date.
EXPIRED PRODUCTS. DISTRIBUTOR shall not sell any Agreement Products beyond their stated expiration date; provided, however, EVOLUS shall only deliver Agreement Products to DISTRIBUTOR that have: (a) during Commercialization Year 1 at least [***] months of their useful life remaining and (b) after Commercialization Year 1 at least [***] years of their useful life remaining.
EXPIRED PRODUCTS. For consignment inventory, legal title to products maintained in OHSU's stocking area and under XXXX's control shall remain with Provider until removed from OHSU's stocking area for use by OHSU. Legal title to a product will transfer to OHSU at the time the product inner package is opened. Expired product will not be considered as used by OHSU under this Agreement. If XXXX discovers expired product under its control, it will immediately pull and quarantine that product and contact a Provider Representative for replacement product at no cost to OHSU.
EXPIRED PRODUCTS. Expired product may be returned for full credit based on [***], unless the product was sold on a non-returnable basis. Credits will be issued for returned product that is [***].
EXPIRED PRODUCTS. Each Contractor is responsible for monitoring and replacing any and all products that reach expiration. These replacements will take place at no expense to Customer.
EXPIRED PRODUCTS. The Distributor shall not sell Products beyond their stated expiration date. With the Company’s written consent, Distributor may return products with fewer than three (3) months until expiration to the Company in exchange for like Products with a later expiration date. All returns of products under this Section shall be at Distributors expense.
EXPIRED PRODUCTS. In the event that any stocks of the Products held by DKSH expires, DKSH shall be entitled to return such expired stocks to CLIENT and CLIENT shall replace all such returned expired Products at its own cost; provided, however, that the replacement of any stocks of the Products which has expired as a result of DKSH’s failure to adhere to the “First Expiry – First Out” (FEFO) rule formulated by DKSH (and notified to CLIENT) as part of DKSH’s inventory management policy shall be at DKSH’s own cost.
EXPIRED PRODUCTS. Distributor shall report quantities of Expired Product to Tazo and the parties will mutually determine proper disposition of all Expired Products. Tazo shall not be obligated to credit Distributor for any Expired Product.
EXPIRED PRODUCTS. XXXXXXX shall not sell any Products beyond their stated expiration date. Expired products will be handled according to the verified XXXXXXX quality control systems guidelines and will be discarded. Alternatively, at XXXXXXX’ election, the products will be shipped back to BIOMATERIALI for disposal.
