Explanatory Statement, Definitions and Exhibits. The Explanatory Statement and definitions set forth at the top of this AGREEMENT and the exhibits referred to in the text of this AGREEMENT, as they may be modified in according with the terms hereof, are incorporated by reference herein and shall constitute substantive parts of this AGREEMENT.
