Extension of Obligations. The obligations of the Company under this Section 6 shall be in addition to any other liability which the Company may otherwise have, and shall extend, upon the same terms and conditions, to each person, if any, who controls any Underwriter within the meaning of the Securities Act; and the obligations of the Underwriters under this Section shall be in addition to any liability that the respective Underwriters may otherwise have, and shall extend, upon the same terms and conditions, to each director of the Company (including any person who, with his consent, is named in the Registration Statement as about to become a director of the Company), to each officer of the Company who has signed the Registration Statement, and to each person, if any, who controls the Company within the meaning of the Securities Act.
Extension of Obligations. The obligations of the Company under this Section 9 shall be in addition to any liability which the Company may otherwise have and shall extend, upon the same terms and conditions, to each person, if any, who controls any Underwriter within the meaning of the Act and each broker-dealer affiliate of any Underwriter; and the obligations of the Underwriters under this Section 9 shall be in addition to any liability which the respective Underwriters may otherwise have and shall extend, upon the same terms and conditions, to each officer and director of the Company (including any person who, with his or her consent, is named in the Registration Statement as about to become a director of the Company) and to each person, if any, who controls the Company within the meaning of the Act.
Extension of Obligations. If you breach any of the provisions of paragraph 2, 3 or 4 of this Agreement, and if the Company brings legal action for injunctive relief, such relief shall have the duration specified in those paragraphs, commencing from the date such relief is granted, but reduced by the period of time elapsed between the Employment Termination Date and your first breach of this Agreement.
Extension of Obligations. The periods in which the obligations under Sections 6, 9, 10, and 11 remain in effect shall be extended day-for-day for any period in which Executive is in breach of this Agreement.
Extension of Obligations. If Employee breaches any of the provisions of Section 4 of this Agreement, and if the Company brings legal action for injunctive relief during the Restricted Period and injunctive relief is ordered by a court of competent jurisdiction, then one day of additional time shall be added to the restriction for each day of noncompliance, up to a maximum of twelve (12) months, so that the Company is given the benefit of Employee’s compliance with the restriction for twelve (12) months following employment as agreed. If, however, the Company takes no action within the Restricted Period, then the Company shall have no right to bring a legal action under this Agreement against Employee.
Extension of Obligations. The obligations of Contractor under this Article 25 shall extend to any trustee in bankruptcy, receiver, administrator or liquidator appointed for Contractor, to Contractor as debtor-in-possession (collectively referred to in this Article as “trustee”), and to any other successor in interest to Contractor. Without limiting the generality of the foregoing, upon written request of Owner, Contractor shall not interfere with the rights of Owner as provided in the Contract or the Escrow Agreement to obtain the Escrow Materials from the Trustee or any other person or entity having possession thereof, and shall, if requested under the conditions specified in the Escrow Agreement for release of the Escrow Materials, cause a copy of such Escrow Materials to be made available to Owner.
Extension of Obligations. The parties will ensure that the provisions of this clause are extended to their employees, agents or contractors.
Extension of Obligations. Licensee shall require each of its sublicensees to agree in writing to be bound by all confidentiality obligations as set forth in this Section 8.
Extension of Obligations. The period of time during which disclosures may be made pursuant to the Confidentiality Agreement dated September 15, 2004 and its latest amendment of July 25, 2006 hereto, is hereby extended for the term of this Agreement and the term of the Supply Agreement. All obligations of confidence and non-use shall extend five (5) years from the termination of this or the Supply Agreement.
Extension of Obligations. Each Party shall comply with the provisions of this Chapter and shall take the necessary measures to ensure compliance by state, departmental and local governments, and shall take such measures in that regard as may be available to it, with respect to non-governmental standardizing bodies in its territory.
