Facility Capacity Adjustment. (A) If Seller has executed an Interim LGIA prior to the start of construction of the Facility, Seller may, during its use of Interim Interconnection Service, decrease the Facility Capacity to the amount permitted to be interconnected pursuant to such Interim LGIA by providing Buyers with written notice of such adjustment. In such event, the Facility Capacity shall, during Seller’s use of Interim Interconnection Service, be no less than ninety percent (90%) of the amount allowed under the Interim LGIA. Seller shall thereafter be entitled to increase the Facility Capacity up to the amount that Seller is authorized to interconnect pursuant to an LGIA to be executed by Seller (but not to exceed 280 MWac).

Facility Capacity Adjustment. (A) Prior to issuance by Seller of full notice to proceed to its EPC contractor, Seller may, on one occasion only, decrease the Expected Facility Capacity by providing Buyer with written notice of such adjustment; provided, however, that Seller may not decrease the Expected Facility Capacity to below the Minimum Demonstrated Capacity without Buyer’s prior written consent, which Buyer may withhold in its sole discretion.

Facility Capacity Adjustment. (A) If Seller has executed an Interim LGIA, the Expected Facility Capacity for purposes of determining whether Commercial Operation has been achieved and during the period Seller uses Interim Interconnection Service and for purposes of calculating the Expected Amount and Deemed Delivered Energy prior to the effectiveness of the Interconnection Agreement, shall be decreased to the amount permitted to be interconnected pursuant to such Interim LGIA; provided that Seller provides notice to Buyers with written notice of such adjustment on or prior to March 31, 2023. Once the Interconnection Agreement becomes effective and permits Seller to make available Solar Energy Output at a capacity higher than that in the Interim LGIA, Seller shall be entitled to increase the Facility Capacity up to the amount that Seller is authorized to interconnect pursuant to the Interconnection Agreement (but not to exceed the Expected Facility Capacity)).

Developer shall implement under-frequency and over-frequency relay set points for the Large Generating Facility as required by the NPCC to ensure “ride through” capability of the New York State Transmission System. Large Generating Facility response to frequency deviations of predetermined magnitudes, both under-frequency and over-frequency deviations, shall be studied and coordinated with the NYISO and Connecting Transmission Owner in accordance with Good Utility Practice. The term “ride through” as used herein shall mean the ability of a Generating Facility to stay connected to and synchronized with the New York State Transmission System during system disturbances within a range of under-frequency and over-frequency conditions, in accordance with Good Utility Practice and with NPCC Regional Reliability Reference Directory # 12, or its successor.

  • FREQUENCY AND CAPACITY LEVELS No restriction on frequency, capacity and aircraft type

HOLD HARMLESS None of iTrip Vacations, Sea Oats Vacation Property Management, Inc. or the owner of the premises assume risk, responsibility or any liability for, and the Tenant hereby releases, waives, relinquishes and discharges iTrip Vacations, Sea Oats Vacation Property Management, Inc., the owner of the premises and all directors, officers, employees, agents or other representatives of such parties from, any (i) loss, damage, illness, injury or exposure to COVID-19, other viruses or the flu to persons or their personal property that occurs during their stay on the premises; (ii) any inconveniences, damage, loss or injury arising from any temporary defects or stoppage in supply of water, gas, cable service, internet service, electricity or plumbing or (iii) any inconveniences, damage, loss or injury arising from or due to weather conditions, insects, natural disasters, acts of God, or other reasons beyond their control. POOL & PATIO If the premises include a private or community pool (including hot tubs), then the Tenant hereby acknowledges that the premises they have reserved include a community pool and the undersigned agrees and acknowledges that the community pool and patio/deck can be dangerous areas, that the deck/patio can be slippery when wet, and that injury may occur to anyone who is not careful. With full knowledge of the above facts and warnings, the undersigned Tenant accepts and assumes all risks involved to Tenant and all of Tenant's guests in or related to the use of the private or community pool (including hot tubs) and patio areas.

  • Local Circuit Switching Capability, including Tandem Switching Capability 4.2.1 Local circuit switching capability is defined as: (A) line-side facilities, which include, but are not limited to, the connection between a loop termination at a main distribution frame and a switch line card; (B) trunk-side facilities, which include, but are not limited to, the connection between trunk termination at a trunk-side cross-connect panel and a switch trunk card; (C) switching provided by remote switching modules; and (D) all features, functions, and capabilities of the switch, which include, but are not limited to: (1) the basic switching function of connecting lines to lines, line to trunks, trunks to lines, and trunks to trunks, as well as the same basic capabilities made available to BellSouth’s customers, such as a telephone number, white page listings, and dial tone; and (2) all other features that the switch is capable of providing, including but not limited to customer calling, customer local area signaling service features, and Centrex, as well as any technically feasible customized routing functions provided by the switch. Any features that are not currently available but are technically feasible through the switch can be requested through the BFR/NBR process.

  • Night Shift Differential 1. An employee who works an assigned night shift shall, in addition to his or her regular salary, be paid a night shift differential for each hour actually worked on the assigned night shift.
