Common use of Facility Equipment Clause in Contracts

Facility Equipment. To the extent any Facility equipment is used in connection with the transport of patients, Transporter agrees to assume reasonable responsibility for such equipment during the transport. Transporter further agrees to return such equipment to Facility as soon as practicable following such transport. Notwithstanding anything in this Agreement to the contrary, Transporter shall not be liable to Facility for damage to or destruction of such equipment, unless such damage or destruction is the result of gross negligence or willful misconduct on the part of Transporter.
