Facility Status. After the Effective Date, Pittsfield, at its sole discretion, may sell, modify, close, or utilize the Facility for sales to others.

In connection with certain Pre-Existing Environmental Conditions, as soon as possible after Closing, Seller shall apply for a modification of facility status (as it relates to the Alachua Facility) to the “Natural Attenuation Monitoring Only” designation with the applicable governmental authority, provided, however that nothing contained herein shall be deemed an obligation by Seller to remediate or undertake any remediation of the Premises in order to obtain such modification of facility status other than as otherwise specifically set forth herein.
