FACTORS INFLUENCING MOU CREATION. 1. There are multiple current factors impacting the need for this MOU. Some, but not all, of the more pertinent factors include the following: a. Colorado’s Front Range population is approximately 3,931,163 people (81.8% of the state’s population) and, urban development and encroachment have limited or eliminated many recreational shooting opportunities on federal, state, county, community and private lands on the Colorado Front Range. Increased public demand for multiple forms of outdoor recreational use including increased recreational shooting necessitates that public land manager’s review perceived impacts on the land from all forms of outdoor recreation. b. Historically, organized and dispersed shooting opportunity along much of Colorado’s Front Range was served by public lands (local, community, county, state and federal) and/ or private shooting ranges. Rising land values due to urban development, urban encroachment, real or perceived liability and issues/perceptions regarding safety from some surrounding residents have all contributed to the reduction of both developed and undeveloped dispersed recreational shooting opportunities. c. The cooperators of this agreement emphasize the necessity for local, state, and federal level public involvement to resolve emerging recreational shooting sports issues. Shooting sport activities and associated projects complement the mission of the cooperating partners and serve the mutual interests of the partners and the public.

  • Access Toll Connecting Trunk Group Architecture 9.2.1 If CSTC chooses to subtend a Verizon access Tandem, CSTC’s NPA/NXX must be assigned by CSTC to subtend the same Verizon access Tandem that a Verizon NPA/NXX serving the same Rate Center Area subtends as identified in the LERG. 9.2.2 CSTC shall establish Access Toll Connecting Trunks pursuant to applicable access Tariffs by which it will provide Switched Exchange Access Services to Interexchange Carriers to enable such Interexchange Carriers to originate and terminate traffic to and from CSTC’s Customers. 9.2.3 The Access Toll Connecting Trunks shall be two-way trunks. Such trunks shall connect the End Office CSTC utilizes to provide Telephone Exchange Service and Switched Exchange Access to its Customers in a given LATA to the access Tandem(s) Verizon utilizes to provide Exchange Access in such LATA. 9.2.4 Access Toll Connecting Trunks shall be used solely for the transmission and routing of Exchange Access to allow CSTC’s Customers to connect to or be connected to the interexchange trunks of any Interexchange Carrier which is connected to a Verizon access Tandem.

The Purchaser must bear the economic risk of this investment until the Securities are sold pursuant to: (i) an effective registration statement under the Securities Act; or (ii) an exemption from registration is available with respect to such sale.

  • Aggravating and Mitigating Factors The penalties in this matter were determined in consideration of all relevant circumstances, including statutory factors as described in CARB’s Enforcement Policy. CARB considered whether the violator came into compliance quickly and cooperated with the investigation; the extent of harm to public health, safety and welfare; nature and persistence of the violation, including the magnitude of the excess emissions; compliance history; preventative efforts taken; innovative nature and the magnitude of the effort required to comply, and the accuracy, reproducibility, and repeatability of the available test methods; efforts to attain, or provide for, compliance prior to violation; action taken to mitigate the violation; financial burden to the violator; and voluntary disclosure. The penalties are set at levels sufficient to deter violations, to remove any economic benefit or unfair advantage from noncompliance, to obtain swift compliance, and the potential costs, risks, and uncertainty associated with litigation. Penalties in future cases might be smaller or larger depending on the unique circumstances of the case.

  • Green Economy/Carbon Footprint a) The Supplier/Service Provider has in its bid provided Transnet with an understanding of the Supplier’s/Service Provider’s position with regard to issues such as waste disposal, recycling and energy conservation.

  • Conflicts with RS Means Unit Price Book If the terms of the solicitation referenced RS Means Unit Price Book occur, the RS Means Book shall control if it determines the legality of the solicitation award as it relates to the requisite Means Unit Price Book.
