Failure to Maintain Availability. (i) When an event-time employee does not maintain his/her required availability as stipulated above, the employee will be placed on the bottom of their classification seniority list for a period of one year. (ii) If the employee does not maintain at least the availability in their category the following year, they may lose their seniority.

  • Failure to Maintain Financial Viability The System Agency may terminate the Grant Agreement if the System Agency, in its sole discretion, determines that Grantee no longer maintains the financial viability required to complete the services and deliverables, or otherwise fully perform its responsibilities under the Grant Agreement.

  • General Availability The commitment to availability specified in the letter of appointment shall be subject to mutually acceptable revision. Such revision will occur once per year, or, if mutually agreed between the Employer and the employee, on a more frequent basis. The Employer will issue a revised letter of appointment to reflect approved changes to employee’s general availability.
