Failure to Provide Eligible Collateral Support. The Contracting Party agrees and acknowledges that upon any failure by the Contracting Party to provide Eligible Collateral Support to Exchange in the amounts and manner set forth under this Agreement, Exchange shall have the rights and remedies set forth in this Agreement including, without limitation, the rights to cause a Contracting Party Suspension, effect the Close-out Procedure and/or effect the Liquidation Procedure with respect to the Contracting Party’s Transactions.
Failure to Provide Eligible Collateral Support. Without limitation to any other rights or remedies of Exchange under this Agreement, at law, in equity or otherwise, if a Failure to Provide Eligible Collateral Support by any Contracting Party occurs, Exchange may exercise any of its rights under Section 5.5 and Section 8.2.
