Failure to Restore Equipment and Improvements; Application of Net Proceeds. If the Company elects not to restore, repair or replace that part of the Equipment or Improvements damaged or destroyed or taken by the exercise of the power of eminent domain, any Net Proceeds not expended in restoring, repairing or replacing such Equipment and Improvements shall be paid to the Trustee for deposit in the Bond Fund and application as provided in Section 10.2.
