Fair Treatment. A. The Warehouse Operator agrees to deal in a fair and reasonable manner with persons storing or seeking to store grain if each of the following conditions are met: (1) the grain is of the kind, type and quality customarily stored or handled in the geographic area; (2) the grain has been tendered to the warehouse in a suitable condition for storage; and (3) the grain is tendered in a manner consistent with the ordinary and usual course of the Warehouse Operator’s business. B. The Warehouse Operator may enter into agreements with depositors or lawful owners to allocate available warehouse storage space.
