Common use of Family Activity Leave Clause in Contracts

Family Activity Leave. Subject to operational needs and reasonable notice to the employer, employees shall be permitted to use accrued leave credits (vacation, annual leave, personal holiday, holiday credits, CTO, PLP) for the purpose of attending school or non- school family- related activities such as sports events, recitals, 4-H, in which the employee’s child is participating. However, such leave shall not diminish an employee’s entitlement under the Family School Partnership Act (Labor Code Section 230.8). Family is defined as the employee’s son, daughter, or any child the employee stands in loco parentis (to the child). Employee leave requests for family activities shall be in accordance with the appropriate departmental procedures. Disputes regarding the denial of the use of leave under this section may be appealed to the 3rd level of the grievance procedure. Nothing in this section is intended to waive or diminish any rights the employee has under State or federal law.
