Common use of Fatal Force Leave of Absence Clause in Contracts

Fatal Force Leave of Absence. An Employee who is required to administer fatal force or its equivalent as determined by the Chief of Police shall receive the necessary time off to relieve the stress which has resulted from the use of such force. The duration of time shall be set by the Chief of Police; however, he/she shall take into account the recommendation, if any, of the Employee's physician. The Employee shall continue to receive his/her pay and benefits for the duration of time as set by the Chief of Police. If the Employee requests additional time off, it shall be charged to vacation, accrued sick time or personal leave of absence. The City shall require an Employee who is subject to time off to relieve stress and undergo social or psychological counseling at the City's expense in a program of the City's choosing.
