FAX AND EMAIL CONSENT. The Parties to this Agreement are authorized to fax and/or email to each other at the numbers/emails shown herein, (or otherwise modified in writing from time to time) shipment availabilities, equipment and rate promotions, or any advertisements of new services. FORCE MAJEURE: In the event that either Party is prevented from performing its obligations under this Agreement because of an occurrence caused by force majeure and arising without its fault or negligence, such failures to perfom (except for any payments due hereunder)shall be excused for the duration of such occurrence. Economic hardships, strikes, lockout or any labour disputes, and mechanical failures of CARRIER’s equipment or driver shortage shall not constitute events of force majeure.
