Common use of Federal Affirmative Action Clause in Contracts

Federal Affirmative Action. A. Contractor understands that the Airports Authority, in the operation and use of the Airport and Premises, is committed to an affirmative action program. Contractor represents and warrants that, to the extent required by law, it shall undertake an affirmative action plan in compliance with all federal rules and regulations, including 14 CFR, Part 152, Subpart E. to ensure that no person shall on the grounds of race, creed, color, religion, age, national origin, or sex be excluded from participating in any employment activities covered in 14 C.F.R. Part 152, Subpart E. Contractor assures that no person shall be excluded on these grounds from participating in or receiving the services or benefits of any program or activity covered by Subpart E. Contractor assures that it will require that its covered suborganizations provide assurances that they similarly will undertake an affirmative action program and that they will require assurances from their organizations, as required by 14 C.F.R., Part 152, Subpart E, to the same effect.
