Fees and Costs of Enforcement. If either party to this Contract shall enforce any of the provisions hereof in any action at law or in equity, the prevailing party to such litigation shall be entitled to recover from the other party or parties all costs and expenses, including reasonable attorneys' fees, incurred therein.

Fees and Costs of Enforcement. Should any Party retain an attorney for the purpose of enforcing or construing this Agreement, in any JAMS arbitration, enforcement proceeding or legal proceeding whatsoever, that Party shall be entitled to receive from the non-prevailing Party reimbursement for all reasonable attorneys’ fees and all reasonable costs, including but not limited to service of process, filing fees, court and court reporter costs, investigative costs, expert witness fees, and reimbursement for all reasonable attorneys’ fees and all reasonable costs shall be included in any final determination or final order issued in the subject arbitration, enforcement action or legal proceeding.
