Common use of Fees for Excess Use Clause in Contracts

You agree to monitor and maintain Your Accounts within all Hi-Tex Solutions LLC-specified limits and in a manner that does not disrupt the activities of Hi-Tex Solutions LLC and other Hi-Tex Solutions LLC customers and users. If Your usage exceeds the limits for Your Account or may disrupt the activities of other Hi-Tex Solutions LLC customers, You agree that Hi-Tex Solutions LLC may immediately, in its sole discretion, (i) charge You for such excess usage via Your automated payment account, or by invoice if You have been accepted into Hi-Tex Solutions LLC’s check paying program, (ii) upgrade You to a plan or increase the limits on Your Account to address this excess usage, and/or (iii) suspend Your Account or terminate Your Account upon notice To You. Usage and associated charges for excess usage will be determined based solely upon Hi-Tex Solutions LLC’s collected usage month. Upon any upgrade or increase on the limits of your account, you will be responsible for the new costs and fees. Unused monthly allotments will not accrue or carry over from one month to any other.
