Requests for Exclusion (Opt-Outs). 8.5.1 Class Members who wish to exclude themselves (opt-out of) the Class Settlement must send the Administrator, by fax, email, or mail, a signed written Request for Exclusion not later than 60 days after the Administrator mails the Class Notice (plus an additional 14 days for Class Members whose Class Notice is re-mailed). A Request for Exclusion is a letter from a Class Member or his/her representative that reasonably communicates the Class Member’s election to be excluded from the Settlement and includes the Class Member’s name, address and email address or telephone number. To be valid, a Request for Exclusion must be timely faxed, emailed, or postmarked by the Response Deadline. 8.5.2 The Administrator may not reject a Request for Exclusion as invalid because it fails to contain all the information specified in the Class Notice. The Administrator shall accept any Request for Exclusion as valid if the Administrator can reasonably ascertain the identity of the person as a Class Member and the Class Member’s desire to be excluded. The Administrator’s determination shall be final and not appealable or otherwise susceptible to challenge. If the Administrator has reason to question the authenticity of a Request for Exclusion, the Administrator may demand additional proof of the Class Member’s identity. Requests for Exclusion (Opt-Outs). Any Class Member that wishes to seek exclusion from the Settlement Class by “opting out” must timely submit a written request for Exclusion to the Claims Administrator (a “Request for Exclusion”). To be effective, such Requests for Exclusion must state: the Settlement Class Member’s full legal name, address and telephone number; that the Class Member purchased Capacitors indirectly from one or more Distributor who themselves purchased from one of the Defendants during the Class Period; and that the Class Member (1) wants to be excluded from the In re Capacitors Antitrust Litigation – Indirect Purchaser Actions class action settlement with Xxxxxxx and (2) understands that by so doing, the Class Member will not be able to get any money or benefits from the settlement with Shinyei under the Settlement Agreement. All Requests for Exclusion must be signed and dated LAW OFFICES COTCHETT, XXXXX & by the Class Member or its officer or legal representative, and be (1) mailed to the Claims Administrator via First Class United States Mail (or United States Mail for overnight delivery) and postmarked by a date certain to be specified on the Notice, or (2) received by the Claims Administrator by that date, provided, however, that if a Class Member mails the Opt-Out Statement pursuant to option (1), it will be effective only if received by the Claims Administrator on or before ten (10) calendar days after the end of the Opt-Out Period. Persons who opt out are not entitled to any monetary award from the Settlement Fund.

Requests for Exclusion (Opt-Outs). (a) Class Members who wish to exclude themselves from (opt-out of) the class components of the Settlement must send the Administrator, by mail, a signed written Request for Exclusion no later than the Response Deadline (plus an additional 14 days for Class Members whose Class Notice is re-mailed). To be valid, the Request for Exclusion must: contain the name of the person requesting exclusion; indicate that they do not wish to participate in the Settlement in the Sierra Xxxxxx, et al. v. LEGOLAND California, LLC, et al., Case No. 37-2021-00052868-CU-OE-CTL, or some other descriptor that identifies the case; and be signed by the person requesting exclusion. The Request for Exclusion must be timely postmarked by the Response Deadline. The date of the postmark on the return mailing envelope shall be the exclusive means used to determine whether a Request for Exclusion has been timely submitted. (b) If the Administrator has reason to question the authenticity of a Request for Exclusion, the Administrator may demand additional proof of the Class Member’s identity. The Administrator’s determination of authenticity shall be final and not appealable or otherwise susceptible to challenge. (c) Every Class Member who does not submit a timely and valid Request for Exclusion is deemed to be a Participating Class Member under this Agreement, entitled to all benefits and bound by all terms and conditions of the Settlement, including the Participating Class Members’ releases under Paragraph 6.2 of the Agreement, regardless of whether the Participating Class Member actually receives the Class Notice or objects to the Settlement. (d) Every Class Member who submits a valid and timely Request for Exclusion is a Non- Participating Class Member and shall not receive an Individual Class Payment or have the right to object to the Settlement. Because future PAGA claims are subject to claim preclusion upon entry of the Judgment, Non-Participating Class Members who are Affected Employees are deemed to release the claims identified in Paragraph 6.3 of this Agreement and are eligible for an Individual PAGA Payment. If a Class Member submits both a Request for Exclusion and a Notice of Objection, only the Request for Exclusion will be accepted and the Notice of Objection will be void.

Each Class Member shall have forty-five (45) calendar days from the 17 mailing of the Notice within which to complete and postmark a written 18 request for exclusion, for return to the Settlement Administrator. Any disputes 28 regarding the timeliness of a request for exclusion or whether a written 1 communication constitutes a valid request that cannot be resolved 2 between the Parties shall be determined by the Court or Arbitrator, 3 whose determination shall be final.
