Flexibility to Reallocate. The Operator shall have flexibility, subject to compliance with the Contract Standards, to (i) reallocate or postpone expenditures within the Operating Budget portion of the Budget, (ii) reallocate or postpone expenditures within the Capital Budget portion of the Budget, and (iii) reallocate between the Operating Budget and the Capital Budget portions of the Budget in order to address changed operational or commercial circumstances or new legal or regulatory requirements. Any such reallocated amounts will be treated as if initially budgeted in the relevant Budget in all respects.

Flexibility to Reallocate. The Service Provider shall have complete flexibility, subject to compliance with the Contract Standards and prior consultation with, but not subject to approval by, LIPA, to (i) reallocate or postpone expenditures within the approved Operating Budget, (ii) reallocate or postpone expenditures within the approved Capital Budget and (iii) reallocate between the approved Operating Budget and the approved Capital Budget in order to address changed operational or commercial circumstances or new legal or regulatory requirements. Any such reallocated amounts will be treated as if initially budgeted in the relevant Budget in all respects, including with respect to the Performance Metric associated with the Cost Management category set forth in Appendix 9 (the “Cost Management Performance Metric”).

All deposits are processed at Bank's processing facility located in San Diego, CA, and are received either electronically, through the mail, or in person. Please do not mail cash deposits. In the event Bank receives cash deposits, you agree that the Bank's determination of the amount of the deposit will be conclusive. The Bank is responsible for mailed deposits only after the Bank has received them. The Bank is not liable for any deposits, including cash, lost in the mail. Remember: when you use the U.S. mail to make a deposit, you will need to allow extra time for the deposit to reach us. The Bank's policy is to make funds from certain electronic deposits available to you on the business day the Bank receives the deposit. However, the Bank may delay the availability of funds from your check deposits to afford us time to verify the deposit and ensure the funds are collected. During the delay, you may not withdraw the funds and the Bank will not use the funds to pay checks you have written or other debits against the account that you have initiated, such as electronic bill payments. Determining the Availability of a Deposit The length of the delay is counted in business days from the day of your deposit. Every day is a business day, except Saturdays, Sundays, and federal holidays. If you make a deposit before our established cutoff time on a business day that we are open, we will consider that day to be the day your deposit is received by the Bank. However, if you make a deposit after our cutoff time or on a day we are not open, we will consider the next business day we are open to be the day of your deposit. The availability of your deposit varies depending on the type of deposit and is explained below. Our deposit cutoff times are as follows: • Branch deposits:
