Form 10-Q. The Company shall have filed its annual report on Form 10-Q for the quarter ended June 30, 2009 with the Securities and Exchange Commission (“SEC”).
Form 10-Q. As soon as available and in any event within 50 days of the end of each fiscal quarter, the Borrower's quarterly Form 10-Q report filed with the Securities and Exchange Commission;
Form 10-Q. OHI shall have filed with the SEC a 10-Q for the quarter ending June 30, 2006 which complies with applicable requirements.
Form 10-Q. Promptly after preparation, and no later than 90 days after the last day of each quarter, Trecora Resources’ Form 10-Q Quarterly Report as filed with the SEC, or any successor agency thereof; and .
Form 10-Q. If available, the Company has provided to the Investors a copy of the most recent draft of its Quarterly Report on Form 10-Q for the quarter ended March 31, 2016.
Form 10-Q. The Company’s Form 10-Q for the fiscal quarter ended September 30, 2012 will be, when filed, identical (other than immaterial differences) to the confidential draft Form 10-Q for the fiscal quarter ended September 30, 2012 made available to Parent prior to the date hereof.
Form 10-Q. Prior to the Closing Time, the Company shall have filed with the Commission its Quarterly Report on Form 10-Q for the fiscal quarter ended January 25, 2004 (the “Form 10-Q”), and the Form 10-Q shall have been incorporated by reference into the Final Offering Memorandum. The financial position of the Company as of January 25, 2004 and the results of operations for the fiscal quarter ended January 25, 2004 of the Company, as presented in the Form 10-Q, shall not be materially and adversely different from such financial position and results of operations presented in the Company’s press release dated February 12, 2004.
Form 10-Q. If the Closing has not occurred prior to August 15, 2012, the Company shall have filed a Quarterly Report on Form 10-Q for the quarterly period ending June 30, 2012, including all of the financial statements as of and for the period ending June 30, 2012 that are required to be contained in such Quarterly Report on Form 10-Q.
Form 10-Q. The Buyer shall prepare a Quarterly Report on Form 10-Q relating to the quarter ended June 30, 2016 (the “Form 10-Q”). Mr. Aland shall use his Reasonable Best Efforts to assist in the preparation of the Form 10-Q and provide all information to the Company’s auditors and counsel to prepare and file the Form 10-Q with the SEC in a timely fashion and to assist the Company otherwise comply with all requirements of applicable federal and state securities laws for the quarter ended June 30, 2016.
Form 10-Q. Prior to the Closing, the Acquiror Company shall have timely filed its Quarterly Report on Form 10-Q for the fiscal period ended June 30, 2012 with the SEC.
