Formal Grievance Step 4 - Arbitration. If no settlement is reached in step 2, or step 3 or if step 3 is not utilized, the Association may submit the grievance to arbitration. It is the sole option of the Association to submit any employee grievance to arbitration. An arbitration award shall not include any monetary award covering timeframes for extensions as well as non-contractual work days such as spring break, summer break, or winter break. However, if the grievance occurred during a non-contractual work day such as during summer break then the arbitration award can cover the timeframe actually worked and affected by the grievance. An arbitration decision may provide relief up to one year prior to the filing date for contact language interpretation issues and for up to three years prior to the filing date for monetary compensation issues. The length of time up to the limits is based on the facts and evidence.
