Common use of FREE AND APPROPRIATE PUBLIC EDUCATION Clause in Contracts

FREE AND APPROPRIATE PUBLIC EDUCATION. The LEA shall provide CONTRACTOR with a copy of, and electronic access to, the IEP including the Individualized Transition Plan (hereinafter referred to as “ITP”) of each student served by CONTRACTOR. CONTRACTOR shall provide to each student special education and/or related services (including transition services) within the NPS/A consistent with the student’s IEP and as specified in the ISA. If CONTRACTOR is an NPS, CONTRACTOR shall not accept a student if it cannot provide or ensure the provision of the services outlined in the student’s IEP. If student services are provided by a third party (i.e., Related Services Provider), CONTRACTOR shall notify LEA if provision of services cease. Pursuant to California Education Code section 56366(b), transportation shall not be provided through the use of services or equipment owned, leased, or contracted by the LEA for students served by CONTRACTOR unless those services and equipment are provided directly or subcontracted by the CONTRACTOR. Unless otherwise agreed to between CONTRACTOR and XXX, CONTRACTOR shall be responsible for the provision of all appropriate supplies, equipment, and/or facilities for students, as specified in the LEA student’s IEP and ISA. CONTRACTOR shall make no charge of any kind to parents for special education and/or related services as specified in the student’s IEP and ISA (including, but not limited to, screenings, assessments, or interviews that occur prior to or as a condition of the student’s enrollment under the terms of this Master Contract). LEA shall provide low incidence equipment for eligible students with low incidence disabilities when specified in the student’s IEP and ISA. Such equipment remains the property of the SELPA/LEA and shall be returned to the SELPA/LEA when the IEP team determines the equipment is no longer needed or when the student is no longer enrolled in the NPS. CONTRACTOR may charge a student’s parent(s) for services and/or activities not necessary for the student to receive a free appropriate public education after: (a) written notification to the student’s parent(s) of the cost and voluntary nature of the services and/or activities; and (b) receipt by the LEA of the written notification and a written acknowledgment signed by the student’s parent(s) of the cost and voluntary nature of the services and/or activities. CONTRACTOR shall adhere to all LEA requirements concerning parent acknowledgment of financial responsibility. Voluntary services and/or activities not necessary for the student to receive a free appropriate public education shall not interfere with the student’s receipt of special education and/or related services as specified in the student’s IEP and ISA unless the LEA and CONTRACTOR agree otherwise in writing.

CONTRACTOR shall adhere to all LEA requirements concerning parent acknowledgment of financial responsibility. Voluntary services and/or activities not necessary for the student to receive a free appropriate public education shall not interfere with the student’s receipt of special education and/or related services as specified in the student’s IEP and ISA unless the LEA LEA, CONTRACTOR, and CONTRACTOR PARENT agree otherwise in writing.

CONTRACTOR may charge a LEA student’s parent(s) for services and/or activities not necessary for the LEA student to receive a free appropriate public education after: (a) written notification to the LEA student’s parent(s) of the cost and voluntary nature of the services and/or activities; and (b) receipt by the LEA XXX of the written notification and a written acknowledgment signed by the LEA student’s parent(s) of the cost and voluntary nature of the services and/or activities. CONTRACTOR shall adhere to all LEA requirements concerning parent acknowledgment of financial responsibilityresponsibility as specified in the LEA Procedures. Voluntary services and/or activities not necessary for the LEA student to receive a free appropriate public education shall not interfere with the scheduling, location and/or LEA student’s receipt of special education and/or related services as specified in the LEA student’s IEP and ISA unless the LEA and CONTRACTOR agree otherwise in writing.

Pursuant to California Education Code section 56366(b), transportation shall not be provided through the use of services or equipment owned, leased, or contracted by the LEA for students served by CONTRACTOR unless those services and equipment are provided directly or subcontracted by the CONTRACTOR. Unless otherwise agreed to between CONTRACTOR and XXX, CONTRACTOR shall be responsible for the provision of all appropriate supplies, equipment, equipment and/or facilities for LEA students, as specified in the LEA student’s IEP and ISA. Unless otherwise agreed to between CONTRACTOR by XXX and XXXCONTRACTOR, CONTRACTOR shall be responsible for the provision of all appropriate supplies, equipment, and/or or facilities for students, a pupil as specified in the LEA student’s IEP and ISArequired by his or her IEP/IFSP. This provision does not apply to voluntary activities unnecessary to provide the student with a free appropriate public education conducted after written notification to parents as to the cost and the voluntary nature of the activity. Unless the activity takes place during a school vacation or holiday, students not participating in such activities shall continue to receive special education and/or related services as set forth in their IEP/IFSPs. CONTRACTOR shall guarantee that all charges to the LEA are consistent, justified, and based on standards applied to all students enrolled and attending the NPS/NPA. If an individual’s IEP/IFSP requires specialized low incidence equipment based on their qualifying disability, the specialized equipment and/or supplies shall be provided by the LEA unless otherwise specified in the ISA. The LEA shall provide the low incidence equipment for eligible students with low incidence disabilities when specified and/or supplies identified in the studentpupil’s IEP and ISAIEP/IFSP, unless the CONTRACTOR specifically agrees in the ISA to provide them. Such Supplies and/or equipment remains purchased and/or provided by the SELPA/LEA remain the property of the SELPA/LEA LEA, and shall be returned to supplies and/or equipment purchased by the SELPA/LEA when CONTRACTOR remain the property of the CONTRACTOR. If the IEP team determines that the individual with an IEP/IFSP requires Assistive Technology and/or Augmentative Alternative Communication (AT/AAC) devices, equipment is no longer needed or when the student is no longer enrolled in the NPS. CONTRACTOR may charge a student’s parent(s) for services and/or activities not necessary for the student to receive a free appropriate public education after: (a) written notification to the student’s parent(s) of the cost and voluntary nature of the services and/or activities; and (b) receipt by materials, the LEA of the written notification and a written acknowledgment signed by the student’s parent(s) of the cost and voluntary nature of the services and/or activities. CONTRACTOR shall adhere to all LEA requirements concerning parent acknowledgment of financial responsibility. Voluntary services and/or activities not necessary for the student to receive a free appropriate public education shall not interfere with the student’s receipt of special education and/or related services as specified in the student’s IEP and ISA provide such items unless the LEA and CONTRACTOR the NPS/NPA agree otherwise otherwise. AT and/or AAC devices, equipment and/or materials purchased by the LEA remain the property of the LEA. In the event that a xxxxxx youth may be placed in writinga NPS, the contractor and XXX will work collaboratively with the XXX Xxxxxx Youth Liaison to ensure and facilitate proper school placement enrollment, transfer of credits, records, grades and checkout from school. (EC 48853.5 (e) (1) and AB490) Whenever a change in xxxxxx child’s residence occurs, the xxxxxx child has a right to remain in the school of origin to the end of the highest grade maintained at that school. Decisions regarding placement are IEP decisions which should include participation of XXX Xxxxxx Youth Liaison as appropriate.

If student services are provided by a third party (i.e., i.e. Related Services Provider), CONTRACTOR shall notify LEA Shasta SELPA/District of Residence if provision of services cease. Pursuant to California Education Code section 56366(b), transportation shall not be provided through the use of services or equipment owned, leased, or contracted by the LEA for students served by CONTRACTOR unless those services and equipment are provided directly or subcontracted by the CONTRACTOR. Unless otherwise agreed to between CONTRACTOR and XXX, CONTRACTOR shall be responsible for the provision of all appropriate supplies, equipment, and/or facilities for students, as specified in the LEA student’s IEP and ISA. CONTRACTOR shall make no charge of any kind to parents for special education and/or related services as specified in the student’s IEP and ISA (including, but not limited to, screenings, assessments, or interviews that occur prior to or as a condition of the student’s enrollment under the terms of this Master Contract). LEA Shasta SELPA/District of Residence shall provide low incidence equipment for eligible students with low incidence disabilities when specified in the student’s IEP and ISA. Such equipment remains the property of the SELPA/LEA and shall be returned to the SELPA/LEA when the IEP team determines the equipment is no longer needed or when the student is no longer enrolled in the NPSnonpublic school. CONTRACTOR shall ensure that facilities are adequate to provide Shasta SELPA/District of Residence students with an environment, which meets all pertinent health and safety regulations. CONTRACTOR may charge a student’s parent(s) for services and/or activities not necessary for the student to receive a free appropriate public education after: (a) written notification to the student’s parent(s) of the cost and voluntary nature of the services and/or activities; and (b) receipt by the LEA Shasta SELPA/District of Residence of the written notification and a written acknowledgment signed by the student’s parent(s) of the cost and voluntary nature of the services and/or activities. CONTRACTOR shall adhere to all LEA Shasta SELPA/District of Residence requirements concerning parent acknowledgment of financial responsibility. Voluntary services and/or activities not necessary for the student to receive a free appropriate public education shall not interfere with the student’s receipt of special education and/or related services as specified in the student’s IEP and ISA unless the LEA Shasta SELPA/District of Residence and CONTRACTOR agree otherwise in writing.

If CONTRACTOR is an NPS, CONTRACTOR shall not accept a student if it cannot provide or ensure the provision of the services outlined in the student’s IEP. Such equipment remains the property of the SELPA/LEA and shall be returned parents, but may respond to the SELPA/LEA when the IEP team determines the equipment is no longer needed or when the those parents’ inquiries concerning additional CONTRACTOR services not required to provide a student is no longer enrolled in the NPSwith a free appropriate public education. CONTRACTOR may charge a LEA student’s parent(s) for services and/or activities not necessary for the LEA student to receive a free appropriate public education after: (a) written notification to the LEA student’s parent(s) of the cost and voluntary nature of the services and/or activities; and (b) receipt by the LEA XXX of the written notification and a written acknowledgment signed by the LEA student’s parent(s) of the cost and voluntary nature of the services and/or activities. CONTRACTOR shall adhere to all LEA requirements concerning parent acknowledgment of financial responsibilityresponsibility as specified in the LEA Procedures. Voluntary services and/or activities not necessary for the LEA student to receive a free appropriate public education shall not interfere with the scheduling, location and/or LEA student’s receipt of special education and/or related services as specified in the LEA student’s IEP and ISA unless the LEA and CONTRACTOR agree otherwise in writing.
