Common use of Fuel Surcharge Clause in Contracts

Fuel Surcharge. The owner-operator will receive in full any applicable surcharge or any other form of rate allowance for fuel authorized by the federal law. If such a surcharge is granted by the federal law, the carrier must immediately file for appropriate tariff increase to cover the same. On the effective date of the appropriate tariff, same will be paid to owner-operator. If any carrier fails to file for same, he shall be liable to owner-operator immediately.
