FUNDS TRANSFER AGREEMENT AND NOTICE. The State of California has adopted as law Article 4A of the Uniform Commercial Code, and the Board of Governors of the Federal Reserve has amended Subpart B of Regulation J. This law and regulation cover the movement of funds by means of wire transfers, Automated Clearing House (ACH) transactions, and some book transfers on the Credit Union’s records. The law is intended to establish a comprehensive legal framework covering the duties, responsibilities, and liabilities of all parties involved in a funds transfer. This Funds Transfer Agreement (Agreement) contains several notices that we are required to provide to you and establishes other terms of agreement that will apply to all funds transfers that involve you and the Credit Union. Using the Credit Union to send or receive funds transfers shall constitute your acceptance of all of the terms and conditions contained in this Agreement. To the extent that the terms contained in this Agreement are different than those in any other agreement or terms of account, this Agreement shall control and be deemed to modify such other agreements or terms of account.

FUNDS TRANSFER AGREEMENT AND NOTICE. Electronic fund transfers which are not consumer electronic fund transfers governed by the Electronic Fund Transfer Act and Regulation E are governed by the Uniform Commercial Code as adopted by California (the “UCC”), the rules and regulations of the funds transfer system through which the funds are sent, and by the terms and conditions stated in this Agreement. These funds transfers include, but are not limited to, transfers to or from accounts through the Federal Reserve Bank system by means of Fedwire or transfers through the automated clearing house (“ACH”) that are subject to the ACH applicable rules or other funds transfer systems and transfers between accounts at our different branches (“on us” transfers). The terms and conditions which follow apply if I request that you act as the “Originating Bank” for a “payment order” from me or as the “Beneficiary Bank” for a payment order to me as these terms are defined in the UCC. These terms do not generally apply to transfers originated by check, draft, or other written item. Using the Credit Union to send or receive funds transfers shall constitute my acceptance of all of the terms and conditions set forth below.

Using the Credit Union to send or receive funds transfers constitutes your acceptance of these terms of agreement. The Credit Union may charge your account for any funds transfer initiated by you, any person authorized as a joint owner, or any other authorized party with the right of access to the account from which the funds transfer is to be made. The Credit Union may establish, from time to time, security procedures to verify the authenticity of a payment order. You will be notified of these procedures, if any will be used to verify payment orders issued by you or for which your account will be liable. You agree the authenticity of payment orders may be verified using said security procedure unless you notify the Credit Union in writing that you do not agree with the security procedure. In that event, we shall have no obligation to accept any payment order from you or other authorized parties on the account until you and the Credit Union agree, in writing, on an alternate security procedure. Wire Transfers Wire transfers are governed by Regulation J. You will receive notice of such transfers on your periodic account statement. If you give the Credit Union a payment order which identifies the beneficiary (person who will receive the funds) by both name and identifying or account number, payment may be made to the beneficiary’s bank based on the identity or account number even if the number identifies a person different than the named beneficiary. If you give the Credit Union a payment order which identifies any bank in the funds transfer by name and by a routing/transit or other identifying number, the Credit Union will rely on the number provided even if it identifies a bank different from the named bank. Unless otherwise provided by the Credit Union in a separate schedule concerning specific types of funds transfers, the cut-off time for receipt and processing of payment orders shall be 4 p.m. EST (EDT) on each business day (Monday-Friday). Payment orders received after the cut off time may not be transmitted until the following business day. FUNDS TRANSFER AGREEMENT AND NOTICE. The purpose of this Funds Transfer Security Agreement is to provide maximum security to our members when wiring funds out of an account at Tri-Valley Service. The wiring of funds will be transferred through VIZO Financial. One security step is to establish a predetermined phone number that will be called by an employee from Tri-Valley Service. We will then verify the wire information that we received earlier. The other security step is to also include a code-word to confirm the wire transfer request. One of the above security procedures will be required on all wire transfers leaving Tri-Valley Service. Please fill in your information, print out completed form and sign before returning to the credit union. The fee for domestic wire transfers $35.00. Wiring instructions must be received by 3PM to be processed the same day. Important: Please contact the Receiving financial institution for wire transfer instructions. Routing Numbers on the bottom of the checks are often not accurate for the purpose of wire Transfers.
