General Intentions. The site demolition end point for Georgia-Pacific is that the buildings and structures are demolished and the debris is removed such that (i) the demolition is completed in a manner and within the timeframes established in this Demolition Plan, (ii) the Property is contoured for drainage to the existing storm water system, (iii) the surfaces remaining after demolition are safely filled and free of protrusions and abrupt edges such that the surfaces are capable of being driven upon by a standard pickup truck, (iv) if the equipment is removed, then all the equipment, the exterior electrical, mechanical, and process systems equipment related to the equipment will be removed from the Remaining Buildings in an acceptable manner so as not to damage the buildings, and (v) all demolition debris has been removed and disposed of in accordance with applicable law.
General Intentions. Georgia-Pacific may be removing equipment from the buildings listed in Exhibit “B” to remain on the Property (the “Remaining Buildings”). Therefore, the equipment will be removed through existing openings, if possible. If removal through existing openings is not possible, then the Port and Georgia-Pacific will agree on a removal plan that allows for the removal of the equipment and provides for the subsequent repair or weatherproofing of the building after removal. When removing the equipment, all of the exterior electrical, mechanical, and process systems equipment related to the equipment will also be removed.

If agreed to by TIPS, they will be incorporated into the final Agreement. A Purchase Order, Agreement or Contract is the TIPS Member’s approval providing the authority to proceed with the negotiated delivery order under the Agreement. Special terms and conditions as agreed to between the vendor and TIPS Member should be added as addenda to the Purchase Order, Agreement or Contract. Items such as certificate of insurance, bonding requirements, small or disadvantaged business goals are some of the addenda possible.

  • Understanding, Fair Construction By execution of this Addendum, the parties acknowledge that they have read and understood each provision, term and obligation contained in this Addendum. This Addendum, although drawn by one party, shall be construed fairly and reasonably and not more strictly against the drafting party than the nondrafting party.

  • General Allegations The Settling Entity enters into this Settlement Agreement on behalf of the noticed violator described in subsection 1.4 below, with whom such Settling Entity has a contract for one or more of the products at issue which contains indemnity and defense clauses.   • State of California Public Liability and Workers’ Compensation Program A. The Judicial Council has elected to be self-insured for its motor vehicle, aircraft liability and general liability exposures.

  • APPLICABILITY TO SUBCONTRACTORS Respondent agrees that all contracts it awards pursuant to the contract awarded as a result of this Agreement will be bound by the foregoing terms and conditions.
