General Plan Compliance. The General Plan Consistency Findings set forth in Motion No. 18883 apply to this Motion, and are incorporated as though fully set forth herein.
General Plan Compliance. With respect to each Benefit Plan, except as noted on the Disclosure Schedule: (a) such Benefit Plan, if it is intended to provide favorable tax benefits to plan participants, has been maintained and continues to be in material compliance with applicable Code provisions; and (b) such Benefit Plan has been and continues to be operated in substantial compliance with its terms and all applicable laws, including, without limitation, ERISA and the Code, and to the extent such Benefit Plan is a group health plan subject to the requirements of Section 4980B of the Code ("COBRA") and/or the Health Insurance Portability and Accountability Act of 1996, as amended ("HIPAA"), has been and continues to be operated in substantial compliance with such COBRA and HIPAA requirements and (c) all payments due from Franklin or any of the Franklin Subsidiaries to date with respect to each Benefit Plan have been timely made.
General Plan Compliance. This Agreement ensures that all development on the Property shall be consistent with City’s General Plan recommendation for the Property as required by A.R.S. § 9-500.05(B).

General Plan Compliance a. Land Use
General Plan Compliance. LANDOWNER desires to facilitate implementation of the General Plan, and LANDOWNER therefore agrees to develop the Property for the Project in a manner consistent with the policies, terms and conditions of the General Plan, provided that LANDOWNER is assured that, unless otherwise provided in this Agreement, no subsequent changes in the General Plan after the Effective Date which would affect LANDOWNER’s Vested Rights shall apply to the Property or the Project during the term of this Agreement, except as expressly provided herein, particularly in regards to Subsequent Approvals and application of a Subsequent Rule.
General Plan Compliance. With respect to each Benefit Plan, except as noted on Schedule 1: (a) such Benefit Plan, if it is intended to provide favorable tax benefits to plan participants, has been in substantial compliance with applicable Code provisions; and (b) such Benefit Plan has been, to the best knowledge of Peoples Bank Corporation, operated in substantial compliance with its terms and all applicable laws, including, without limitation, ERISA and the Code, and to the extent such Benefit Plan is a group health plan subject to the requirements of Section 4980B of the Code ("COBRA"), has been, to the best knowledge of Peoples Bank Corporation, operated in substantial compliance with such COBRA requirements.
General Plan Compliance. The St. Luke's Campus Hospital and MOB Project is, on balance, consistent with the Objectives and Policies of the General Plan, as outlined in Motion No. 18883.
General Plan Compliance. The Cathedral Hill Project is, on balance, consistent with the Objectives and Policies of the General Plan, as outlined in Motion No. 18883.
