Governmental Approval Contingency. Lessee’s right to use the Leased Premises is expressly made contingent upon it obtaining all the certificates, permits, zoning and other approvals that may be required by any federal, state or local authority.

Governmental Approval Contingency. All parties acknowledge and agree that while the due diligence period is 60 days for physical due diligence, that amount of time is inadequate to obtain land use approvals for the Buyer’s proposed industrial/commercial use. Therefore, for a period of 120-days after the execution of the contract, to run with concurrent with the 60 day due diligence period, this sale is also contingent upon the Buyer obtaining final non-appealable approvals from all appropriate governmental authorities for industrial and/or commercial use. These approvals include but are not limited to the Millville Zoning/Planning Board for any and all prospective site plans and use variances.
