WITHIN GRADE INCREASES Section 1. This Article and appropriate law, regulation or procedure governs within grade step increases.
Downgrade Event If Downgrade Event is indicated as Applicable on the Cover Sheet, if at any time there occurs a Downgrade Event in respect of a Party, then the other Party may require Performance Assurance in an amount determined by that Party in a commercially reasonable manner. Failure to provide such Performance Assurance to the requesting Party within three Business Days of request is an Event of Default.
Night Shift Differential 1. An employee who works an assigned night shift shall, in addition to his or her regular salary, be paid a night shift differential for each hour actually worked on the assigned night shift.
Carry Forward to a Subsequent Year If you do not withdraw the excess contribution, you may carry forward the contribution for a subsequent tax year. To do so, you under-contribute for that tax year and carry the excess contribution amount forward to that year on your tax return. The six percent excess contribution penalty tax will be imposed on the excess amount for each year that it remains as an excess contribution at the end of the year. You must file IRS Form 5329 along with your income tax return to report and remit any additional taxes to the IRS.
Seniority Tie Breaker The Employer and the Union agree that where there is a tie in seniority between two or more Employees, a determination of seniority shall be made in the following manner:
Yeah Well I mean I think look, we (done all the credit checks) within the last 12 months. So and I’ve been throw all the accreditation process very recently. And I’ve been talking to the Registrar Liaison Team about, you know, the entire experience. I mean the - I’d actually go so far as to say I mean at the moment the way it is, it’s - there are quite a lot of checks. You do have to basically state that, you know, you’re not a criminal. That you haven’t done this, you haven’t done that as Xxxxx rightly points out. If you were to start writing in very specific clauses and it would probably cause more problems then it would actually solve because don’t forget ICANN is in many respects very much an American centered organization in terms of references that are posed in a lot of these documents are very, very much American centered. And while under our European law we as a company are required to comply at a much higher level than what would seem to be the case for some of our American counterparts. The manner in which that is actually checked in an American context versus the way it can be checked with an European context is very, very different. So I’d be against, very much against the idea of prescribing anything far too specific because I can just see it causing more headaches. Xxxxx Xxxxxxxx: Okay, any other comments on this? Let me suggest on this one that there really are two parts here. One is the due diligence part prior to accreditation. And as Xxxxx said, that application appears to be under review. As far as the second - after someone has been accredited, I think the question is the specificity with which ICANN’s ability to audit is spelled out and whether for example there ought to be a specific provision on that. Under-Frequency and Over Frequency Conditions The New York State Transmission System is designed to automatically activate a load- shed program as required by the NPCC in the event of an under-frequency system disturbance. Developer shall implement under-frequency and over-frequency relay set points for the Large Generating Facility as required by the NPCC to ensure “ride through” capability of the New York State Transmission System. Large Generating Facility response to frequency deviations of predetermined magnitudes, both under-frequency and over-frequency deviations, shall be studied and coordinated with the NYISO and Connecting Transmission Owner in accordance with Good Utility Practice. The term “ride through” as used herein shall mean the ability of a Generating Facility to stay connected to and synchronized with the New York State Transmission System during system disturbances within a range of under-frequency and over-frequency conditions, in accordance with Good Utility Practice and with NPCC Regional Reliability Reference Directory # 12, or its successor.
MUSIC USAGE RETURN 15.1 The Licensee must, for the duration of the Agreement and on a quarterly basis, submit to SAMRO the following information regarding each and every Work of Music Performed at the Premises: the name of the Work of Music; the name(s) of each composer; the name(s) of the arranger; the name(s) of the performer; the name(s) of the publisher; and the number of times each Work of Music was Performed.
Cash Shortages No employee may be required to make up cash register shortages unless he or she is given the privilege of checking the money and daily receipts upon starting and completing the work shift, and unless the employee has exclusive access to the cash register during the work shift and unless cash is balanced daily, except as specified below. No employee may be required to make up register shortages when Management exercises the right to open the register during the employee's work shift, unless the register is opened in the presence of the employee and the employee is given the opportunity to verify all withdrawals and/or deposits. No employee shall be held responsible for cash shortages unless he or she has exclusive access to his or her cash.
Commercial Operation Date (COD 15.1.1 The Project shall be deemed to be complete when the Completion Certificate or the Provisional Certificate, as the case may be, is issued under the provisions of Article 14, and accordingly the commercial operation date of the Project shall be the date on which such Completion Certificate or the Provisional Certificate is issued (the “COD”). The Project shall enter into commercial service on COD whereupon the Concessionaire shall be entitled to demand and collect Annuity Payments in accordance with the provisions of this Agreement.
