Grievance Procedure Definitions. (a) A grievance shall be defined as an alleged violation, misinterpretation or misapplication of the express terms of this Agreement. (b) The time elements in the Steps may be shortened or extended upon written mutual agreement between the parties. (c) For the purpose of processing grievances, working days shall be defined as Monday through Friday, excluding all paid holidays. (d) Any employee or Association grievance not presented for disposition through the Grievance Procedure within ten (10) working days of the occurrence of the condition giving rise to the grievance, or within ten (10) working days of the date it is reasonable to assume that the employee or the Association first became aware of the conditions giving rise to the grievance, unless the circumstances made it impossible for the employee or the Association, as the case may be, to know prior to that date that there were grounds for such a claim, the grievance shall not thereafter be considered a grievance under this Agreement. (a) Any employee having a grievance shall discuss the grievance with his/her Supervisor and they shall attempt to resolve it. (b) If the grievance is not settled verbally, the employee may, no later than ten (10) working days later, file a written grievance and request a meeting with the Association Representative and Supervisor to discuss the grievance. (c) The Supervisor shall have ten(10) working days after the meeting to reply in writing to the grievance.
