Filling of Vacancies.
1. In the event of a vacancy, positions shall be filled on the basis of first: ability and qualifications to perform the duties of the classification and second, where the "first" is equal among two or more applicants, seniority will govern. Employees who are in the same classification who bid for transfer into a vacancy shall be offered the opportunity to interview for such vacancy.
2. All job vacancies shall be posted in each of the unit divisions for ten (10) workdays. A copy of the announcement shall also be provided to up to one xxxxxxx from each college, as designated by the MSEA. Notice of vacancies shall include the full particulars of the positions, including a job description, job location, pay rate, required qualifications and requirements for applying. Any employee wishing to be considered for an applicable vacancy shall file a written, dated application within the posting period. Job posting notices shall indicate the name and title of the person to whom applications should be submitted. Seasonal and part-time employees shall have the right to apply for full-time vacancies and shall be given consideration in accordance with their abilities, qualifications and seniority. Employees promoted under the provisions of Section 1 of this Article will be in a probationary status for a period of three (3) months from the effective date of the promotion. Such probationary period may be extended for just cause for an additional three (3) months. The Trustees will provide the written notice regarding the status of the probationary period (pending unforeseen circumstances) at least two (2) weeks prior to the end of the probationary period. Time off for unpaid leave during probation or extension of probation shall not count toward completion of probation. During such periods the employee may be removed from the position promoted to for failure to fulfill the duties of the position. In such case, he/she shall be returned to his/her former position if the employee so desires. An employee filling positions created by the promotion shall be likewise entitled to return to his/her former position. Filling of Vacancies. In the case of any increase in the number of Managers, or of any vacancy in the Board of Managers, the additional Manager shall be appointed by the Beneficial Owner.
Filling of Vacancies.
4.1 The Employer will determine when a position will be filled, the type of appointment to be used when filling the position, and the skills and abilities necessary to perform the duties of the specific position within a job classification that is being filled. If the Employer intends to convert a position which results in it no longer being in the bargaining unit, the Employer will fulfill its obligation to bargain. Only those candidates who have the position-specific skills and abilities required to perform the duties of the vacant position will be referred for further consideration by the employing agency.
4.2 An agency’s internal layoff list will consist of employees who have elected to place their name on the layoff list through Article 35, Layoff and Recall, of this Agreement and are confined to each individual agency.
4.3 The statewide layoff list will consist of employees who have elected to place their name on the statewide layoff list in accordance with WAC 000-00-000.
4.4 A promotional candidate is defined as an employee who has completed the probationary period within a permanent appointment and has attained permanent status within the Agency.
4.5 A transfer candidate is defined as an employee in permanent status in the same classification as the vacancy within the Agency.
4.6 A voluntary demotion candidate is defined as an employee in permanent status moving to a class in a lower salary range maximum within the Agency.
4.7 When filling a vacant position with a permanent appointment, candidates will be certified for further consideration in the following manner:
A. The most senior candidate on the Agency’s internal layoff list with the required skills and abilities who has indicated an appropriate geographic availability will be appointed to the position.
B. If there are no names on the internal layoff list, the Agency will certify up to twenty (20) candidates for further consideration. Up to seventy-five percent (75%) of those candidates will be statewide layoff, agency promotional, internal transfers, and agency voluntary demotions. All candidates certified must have the position-specific skills and abilities to perform the duties of the position to be filled. If there is a tie for the last position on the certification for either promotional or other candidates, the Agency may consider up to ten (10) additional tied candidates. Filling of Vacancies. 17.01 The Employer shall post notice of all vacancies describing the position, hours of work, shift rotation, work area, the date of commencement, a summary of the job description and the required qualifications for a minimum of seven (7) calendar days prior to selection. The parties agree that this provision does not prevent the Employer from simultaneously commencing an external recruitment process.

Concerning the injured worker, light duty assignments can be made without regard to the requirements of Articles 20 -Differential Pay, 52- Change in Classification Specifications, 53 - Reclassification Upward -Reclassification Downward, 54 - Position Descriptions and Performance Evaluations and 55 - Work Schedules, except where specific work assignments have been designated for return of injured workers. Although duties of non-injured staff may be temporarily (not to exceed six (6) months) changed, such change may not give rise to a claim under the Articles listed above. Vacancies will be filled based on merit principles with a commitment to upward mobility through the use of lists of eligible candidates, except for direct appointments, transfers, demotions, or reemployments. Lists shall be established through the use of tests which determine the qualifications, fitness, and ability of the person to perform the required duties. The Department and the Agency retain all rights, except as modified in Articles 45.1--45.5, to determine the method(s) of selection and to determine the individuals to fill vacancies.
Section 2. Except for the Agency layoff list, Articles 45.1-45.5, and Secondary Recall List (Article 70, Section 11.), the Employer retains all rights to fill a vacancy using any of the following methods or lists as appropriate. The appropriate Agency layoff list shall take precedence over all other lists, reemployment, and direct appointment.

For positions in classifications designated in Appendix A, the following shall apply: In the event of a vacancy in a position after application of the recall provisions in this Article, such vacancy shall be filled from among eligible employees on the basis of ability and qualifications to perform the duties of the position. Where qualifications and ability are substantially equal, seniority will be the governing factor in final selection. Vacancies shall be filled as follows:
a. from employees within the applicable MCC who bid for transfer;
b. from employees within the applicable MCC who bid for promotion;
c. from employees within MCC System service who bid for transfer;
d. from employees within MCC System service who bid for promotion; and
e. from applicants outside the MCC System. Where such election involves a bona fide need for special skills and/or special qualifications do not exist among the applicants from within the applicable MCC or MCC System service, the above preference for selection shall not preclude the agency from outside selection. Notwithstanding the above, it is understood there should be no conflict with affirmative action principles, and where there is an affirmative action plan in place, such plan shall be controlling.
2. For positions in classifications designated in Appendix B, the following shall apply. In the event of a vacancy in a position, after application of the recall provisions of this article, such vacancy shall be filled on the basis of: first ability and qualifications to perform the duties of the classification and second, where the "first" is equal among two or more applicants, seniority will govern.
a. The appointing authority shall seek applicants from within the bargaining unit through the posting and application procedure described herein. The appointing authority may also seek applicants from outside the bargaining unit concurrently with internal positing procedures.
b. Each bargaining unit applicant who meets the minimum qualifications shall be entitled to an interview and considered for appointment to the vacancy.
c. On the basis described above, the appointing authority shall evaluate the bargaining unit applicants. The appointing authority shall then, on the same basis, select a bargaining unit applicant to fill the vacancy or evaluate applicants from outside the bargaining unit.
