Habitat Maintenance Account. The Program Manager shall cooperate with the State Parties who will establish an interest bearing Habitat Maintenance Account(s) for the deposit of funds contributed by the State Parties for habitat maintenance pursuant to section 5.4.2 of the HCP and section 8.4.2 of this Agreement. Interest earned on the Habitat Maintenance Accounts shall be added to the account for the purpose of implementation of the LCR MSCP and shall be available to Reclamation, as outlined in the Conservation Plan. Any such interest shall not be credited towards the Contribution of any Party. The custodian of each account shall provide Reclamation a monthly accounting of the account’s status and earnings.
Habitat Maintenance Account. In each of the first ten years of the LCR MSCP, a share of each quarterly payment from the Permittees of each state shall be set aside in an interest bearing account in an amount equal to the proportionate amount that the annual “Existing habitat maintenance” line item in Table 7-1 of the HCP bears to the total annual cost for such year. The investment earnings on any Habitat Maintenance Accounts shall be credited as provided in section 7.5.1(C) of this Agreement.
