Common use of Hazardous Environments Clause in Contracts

Hazardous Environments. You hereby acknowledge that the Product is not intended or licensed for use in hazardous environments, including, but not limited to, nuclear plants, airborne navigation systems, air traffic control, life support systems, weapon systems or in any other systems which may cause bodily injury or death due to Product failure or the impossibility to use the Product. The Manufacturer and the Manufacturer's Trading Partner hereby disclaim any explicit and implicit warranties and responsibilities arising from using the Product in these environments. a) The Manufacturer or the Manufacturer's Trading Partner shall not be held liable for any consequential, accidental or special damage, including, but not limited to, loss of profit, interruption of business or loss of data due to the impossibility to use this Product, even if the Manufacturer is informed that the Product may cause such damage. The liability for any damage caused by this Product and/or the impossibility to use this Product shall be governed by the Commercial Code of the Czech Republic, to which you express your consent by agreeing to this License Agreement. If any damage is caused for which the Manufacturer could be held liable, or if the jurisdiction of any country does not allow to exclude or limit the liability for damage, a contractual fine shall be hereby stipulated amounting to one hundred Czech Crowns. This contractual fine already includes a lump-sum compensation for any damage incurred.
