Hazardous Substance Information. Contractor shall provide the following to Company for the materials or equipment (including any part thereof) delivered under this Agreement: (a) reference to the applicable Material Safety Data Sheet for each material containing a “hazardous material,” as defined by California Health and Safety Code Section 25501(n)(2)(A); and (b) a written statement for each material that is a “mixture or trade name product” that contains a “toxic chemicalsubject to the reporting requirements of Section 313 of the Emergency Planning and Community Right-to-Know Act, including the name and associated Chemical Abstract Services Registry number of such toxic chemical, the specific concentration at which each such toxic chemical is present in each such mixture or trade name product, and the weight of each such toxic chemical in each such mixture or trade name product. Without limiting the generality of the foregoing, if Contractor is obligated to provide a warning to pursuant to California’s Safe Drinking Water and Toxic Enforcement Act (Proposition 65) to exposed individuals with respect to the materials or equipment or as part of the performance of Contractor’s obligations hereunder, Contractor shall provide such warning to such individuals, including, as applicable, members of the public, Company’s employees, Contractor’s employees, and all other Contractor Party employees.

Hazardous Substance Information. Seller shall provide Buyer with a Material Safety Data Sheet ("MSDS") as defined in 29 CFR §1910.1200, or equivalent information, for any Hazardous Substance delivered pursuant to this purchase order. For purposes of this paragraph, "Hazardous Substance" shall be defined as provided by California Health and Safety Code §25316 and California Labor Code §6390, and shall include all hazardous chemicals and mixtures for which an MSDS is required under the Occupational Safety and Health Act of 1970 (29 USCA §651 et seq.) and regulations promulgated under that Act. Nothing contained in this paragraph shall relieve Seller from complying with applicable federal, state, and local laws, codes, ordinances and regulations relating to Hazardous Substances.
Hazardous Substance Information. Contractor shall provide the following to Company for each material which Contractor furnishes to a Company facility, at any time, for use in fulfilling its obligations under this Agreement: (a) a completed Material Safety Data Sheet (MSDS) for each material which contains a hazardous material as defined by California Health and Safety Code Section 25501(o); and (b) a written statement for each such material that is a Mixture or Trade Name Product which contains a Toxic Chemical subject to the reporting requirements of Section 313 or EPCRA (40 CFR Section 372 et seq.) including: (1) the name and associated CAS (Chemical Abstract Services Registry) number of the Toxic Chemical; (2) the specific concentration at which each such Toxic Chemical is present in each such Mixture or Trade Name Product; and

  • Hazardous Substance Hazardous Substance" shall mean any chemical, substance, material, or waste, including without limitation asbestos, PCBs and formaldehyde, that is defined, classified, listed, or designated as hazardous, toxic, or radioactive, or by other similar term, by any federal, state, or local environmental statute, regulation, rule, order, or ordinance presently in effect.

  • Hazardous Substances The words "Hazardous Substances" mean materials that, because of their quantity, concentration or physical, chemical or infectious characteristics, may cause or pose a present or potential hazard to human health or the environment when improperly used, treated, stored, disposed of, generated, manufactured, transported or otherwise handled. The words "Hazardous Substances" are used in their very broadest sense and include without limitation any and all hazardous or toxic substances, materials or waste as defined by or listed under the Environmental Laws.
