Hire Period. 8.1 Hire charges shall commence from the time the Equipment is collected by the Client from the Supplier’s premises and will continue until the return of the Equipment to the Supplier’s premises, or as specified in the specified Hire Period as follows: (a) Half Day – four (4) hours or overnight providing the Equipment is collected after 4pm and returned by 8.30am the following day with a maximum usage time of four (4) hours. (b) Daily – twenty four (24) hours with a maximum usage time of 8 hours. Should the current Weekly rate be lesser than the accumulated daily rate, then the Weekly hire rate will apply. (c) Weekly – shall mean five (5) consecutive days with a maximum usage time of fifty six (56) hours. (e) Weekend – shall be as agreed with the Supplier, otherwise daily hire rates will apply. 8.2 If the Supplier agrees with the Client to deliver and/or collect the Equipment, hire charges shall commence from the time the Equipment leaves the Supplier’s premises and continue until the Client notifies the Supplier that the Equipment is available for collection, and/or until the expiry of the Minimum Hire Period, whichever last occurs. 8.3 The date upon which the Client advises of termination shall in all cases be treated as a full day’s hire. 8.4 Late return will incur a minimum of four (4) hour additional fee. 8.5 If the Client wishes to de-hire the Equipment at an earlier date than was originally agreed, then the Supplier reserves the right to charge the Client at the applicable rate for the actual Hire Period used and any long term discount previously applied will be void. 8.6 No allowance whatsoever can be made for time during which the Equipment is not in use for any reason, unless the Supplier confirms special prior arrangements in writing. In the event of Equipment breakdown provided the Client notifies the Supplier immediately, hiring charges will not be payable during the time the Equipment is not working, unless the condition is due to negligence or misuse on the part of or attributable to the Client.

Where the meter is found not to be working either during or at the Termination Date then Proquip will estimate the hours used and the onus is on the Client to prove otherwise.
24.2 Hire charges shall commence from the time the Equipment is collected by the Client from the SupplierProquip’s premises and will continue until the return of the Equipment to the SupplierProquip’s premises, or as specified in and/or until the specified expiry of the Minimum Hire Period, whichever last occurs.

8.3 The date upon which 24.6 Equipment must be returned or made available for collection by 9am on the Client advises of termination shall in all cases be treated as a full day’s hiredesignated off-hire day or additional charges will apply.
8.4 Late return will incur a minimum of four (4) hour additional fee.
8.5 If the Client wishes to de-hire the Equipment at an earlier date than was originally agreed, then the Supplier reserves the right to charge the Client at the applicable rate for the actual Hire Period used and any long term discount previously applied will be void.
8.6 24.7 No allowance whatsoever can be made for time during which the Equipment is not in use for any reason, unless the Supplier Proquip confirms special prior arrangements in writing. In the event of Equipment breakdown provided the Client notifies the Supplier Proquip immediately, hiring charges will not be payable during the time the Equipment is not working, unless the condition is due to negligence or misuse on the part of or attributable to the Client.

8.2 If the Supplier agrees with the Client to deliver and/or collect the Equipment, hire charges shall commence from the time the Equipment leaves the Supplier’s premises and continue until the Client notifies the Supplier you advise us that the Equipment is available ready for collectionremoval from the Worksite. If you revoke the Off-Hire Notice or have continued to use the Equipment after the Off-Hire period has occurred, and/or then the Hire Charges shall continue without interruption until the end of the Hire Period or until the expiry of the Minimum Hire Period, Period (whichever last occursoccurs last).
8.3 The date upon which 8.3. It is agreed by both parties that:
(a) any return of Equipment to our premises must be completed during our regular business hours and while our staff are present;
(b) in the Client advises event the Equipment is not returned to us by the end of termination shall in the specified Hire period, you will be charged at our current daily rate until the Equipment is returned; and
(c) you must not submit the Equipment for return if it has not been cleaned (including the removal of all cases be treated asbestos fibres or other hazardous substances such as a full day’s hiremortar, render, epoxy, or other applied finish debris).
8.4 Late return will incur a minimum of four (4) hour additional fee.
8.5 If the Client wishes to de-hire the Equipment at an earlier date than was originally agreed, then the Supplier reserves the right to charge the Client at the applicable rate for the actual Hire Period used and any long term discount previously applied will be void.
8.6 8.4. No allowance whatsoever can be made for time during which the Equipment is not in use used for any reason, reason unless the Supplier confirms we confirm special prior arrangements in writing. In the event of any Equipment breakdown malfunction (provided the Client notifies the Supplier you notify us immediately), hiring charges Hire Charges will not be payable during the time the Equipment is not working, working (unless the condition malfunction is due to negligence or misuse on the your part of or is attributable to your actions).
8.5. We retain the Clientright at all times during the Hire Period to inspect the Equipment.
8.6. Where you request us to inspect the Equipment other than the initial or weekly inspection, you acknowledge and agree that all associated costs for such Services shall be charged additionally as a variation (in accordance with clause 7).
8.7. None of the Equipment shall be sublet or cross-hired by you, and you agree to not assign or transfer your interest in this Agreement, or part with possession of all, or any component of the Equipment, without our prior written consent (which may be withheld at our sole discretion).
8.8. Should the Hire of the Equipment exceed a twelve (12) month Hire Period (or a six (6) month Hire Period with the right of renewal), clause 21 shall apply and will constitute a Security Agreement in the form of a lease for a term of more than one (1) year (as defined in Part 2, section 16 of the PPSA). You agree that we may register a security interest as a Purchase Money Security Interest (PMSI) over the Equipment supplied (the collateral).

Notification is to be made by telephone to Protrade by the expiry Customer when the Equipment is ready for collection. Return time is to be no later than 5 pm during weekdays or Protrade shall be entitled to charge another day’s full hire at the current rate. Delivery and collection shall be to the front footpath of the Minimum Hire Period, whichever last occursCustomer’s premises.
8.3 22.3 The date upon which commencement of the Client advises Hire period shall be documented on the delivery docket issued by Protrade and the conclusion of termination the Hire period shall in all cases be treated as a full day’s hiredocumented on the return docket issued by Protrade.
