Home-State Designation and Responsibilities. 12 13 To participate in XXXX, institutions must be reviewed and authorized by their 14 home state, which is the institution's state of legal domicile for purposes of SARA5. 15 The entity or agency designated by the home state is responsible for authorizing 16 the institution for purposes of XXXX and serves as the default forum for 17 consumer complaints. 19 By agreeing to join XXXX, the home state accepts the obligation and assures its 20 capacity and authority—whether through law or mutually accepted, binding 21 contractual agreements with constitutionally autonomous institutions—to evaluate 22 and certify institutional compliance with quality standards detailed herein and to 23 receive and resolve consumer complaints. Specific state responsibilities related to 24 XXXX are further described in Section 4. 26 The home state has a right to oversee its home-state institutions and the in-state 27 activities of institutions that have physical presence in its borders as the home state 28 sees fit. 5 XXXX staff has taken the position that a corporate headquarters cannot serve as the basis for a home state designation under XXXX because it may oversee colleges based in multiple states and having different institutional accreditors. Therefore the legal domicile for purposes of XXXX is the state where the principal accredited campus and the U.S. OPEID number are based. In the event that these two are in different states, the affected regional compacts determine which state serves as home state.
