TEACHER RIGHTS AND RESPONSIBILITIES. A. Teachers shall have freedom in the implementation of the adopted curriculum, including the right to select materials and engage in classroom discussions as they relate to the subject matter being taught and the level of the student. The administrator has the right and obligation to question, consult, and direct whenever necessary.
B. A teacher may express his/her own opinions in regard to political, social, and religious issues provided that the total presentation is essentially balanced and fair. S/he shall not use his/her professional contacts with students to impose upon them his/her personal convictions or those of any other individual or group.
C. Teachers shall be responsible for determining students’ grades and promotions pursuant to district-wide policies. Any administrative change in a grade or promotion shall not be made without attempting prior consultation with the teacher. If such a change is necessary, the administrator shall initial the change on the student’s permanent record and indicate if the change was made without the teacher’s agreement.
D. Teachers shall assist in the selection of instructional materials both on a District-wide and school-wide basis. A teacher shall not be held responsible for the cost of any instructional material a student has lost, destroyed or damaged.
1. A teacher shall have easy access to all locally used state adopted textbooks in each of the courses s/he teaches. A teacher shall be provided with a copy of the textbook, teacher guide and activity manual and, to the extent feasible, any supplemental materials which are used in each of the courses s/he teaches.
2. A teacher may purchase materials and supplies with school-based funds for school use with the prior approval of the administrator.
E. Each teacher shall assume such authority for the control of students assigned to him/her by the administrator, and shall keep order in the classroom and in other places in which s/he is assigned to be in charge of students.
1. During preplanning or prior to any student contact, each teacher shall be provided with an online copy of the Orange County Code of Student Conduct and current Student Referral form and any additional disciplinary plan and forms referenced in the plan which may have been developed for his/her school.

TEACHER RIGHTS AND RESPONSIBILITIES. A. The Association and the teachers recognize that the basic duty of each teacher is to use his/her skill and expertise in the most effective and proper manner to improve the quality of the educational process in the Lapeer Schools.
B. Nothing contained herein shall be construed to restrict to any teacher any rights he/she may have under the Michigan General School Laws or Constitution of Michigan and/or of the United States or any applicable state and federal laws and/or regulations.
C. In order to facilitate the continued improvement of the education process of the Lapeer Schools, to better enable the teachers to fulfill their obligations to the system, and to promote the continued cooperation of the faculty and staff, the Association, teachers, and the Board agree:
1. Department chairs will be established and will function as described in Appendix E.
TEACHER RIGHTS AND RESPONSIBILITIES. A. The Board agrees that the administration will give all necessary assistance to teachers with respect to the maintenance of control and discipline in the classroom. Teachers agree to help supervise students throughout the school building and during assemblies and special programs.
B. The Board recognizes that a teacher may use such reasonable force as is necessary to maintain order and control in a school or a school related setting for the purpose of providing an environment conducive to safety and learning. In maintaining that order and control, the person may use physical force upon a pupil as may be necessary for any of the following:
1. To restrain or remove a pupil whose behavior is interfering with the orderly exercise and performance of school district or public school academy functions within a school or at a school-related activity, if that pupil has refused to comply with a request to refrain from further disruptive acts.
2. For self-defense or the defense of another.
3. To prevent a pupil from inflicting harm on himself or herself.
4. To quell a disturbance that threatens physical injury to any person.
5. To obtain possession of a weapon or other dangerous object upon or within the control of a pupil.
TEACHER RIGHTS AND RESPONSIBILITIES. A. The Association and the teachers recognize that the basic duty of each teacher is to use his/her skill as a teacher in the most effective and proper manner to insure the highest quality of education in the Grand Haven Area Public Schools.
B. Good teaching extends beyond classroom walls and scheduled hours. Teaching is a profession, which requires, among other things, the devotion of extra time to self-improvement and out-of- school time for the preparation of projects, lesson plans, grading of papers, and counseling parents.
C. In order to insure continued improvement of the educational process in the Grand Haven Area Public Schools, the Association and the teachers will continue in accordance with past practices to assist in the study, review, revision, updating and amending of the school curriculum through department and grade committees.
D. The Association and the teachers recognize their obligation to continue to lend their skill and knowledge in the form of recommendations for textbook selections, teaching materials, and plans for new or renovated buildings. The Board's decision in these matters shall be final.
TEACHER RIGHTS AND RESPONSIBILITIES. A. Nothing contained herein shall be construed to deny or restrict to any teacher rights he/she may have under the Michigan General School Laws or other applicable laws and regulations. The rights granted to teachers hereunder shall be deemed to be in addition to those provided elsewhere.
B. Teachers shall be entitled to full rights of citizenship and no religious or political activities of any teacher or the lack thereof shall be grounds for any discipline or discrimination with respect to the professional employment of such teacher. The private and personal life of any teacher is not within the appropriate concern or attention of the Board of Education unless it is proven to reflect adversely on the teacher, other faculty members, the students, or the Board of Education.
C. The provisions of this Agreement and the wages, hours, terms, and conditions of employment shall be applied in a manner which is not arbitrary, capricious, or discriminatory and without regard to race, creed, religion, color, national origin, age, sex, handicap or marital status.
D. Teachers shall make preparation for daily instruction.
E. While not mandatory, teachers are encouraged upon request to serve on committees approved by the administration for the improvement of the Madison District Schools.
F. Teachers may be required to give reasonable account for student behavior, materials used, and facilities assigned to them.
G. Teachers will not organize any club or student group within the school without prior approval of the Board.
H. Each teacher can review the contents of his/her own personnel file, excluding teacher placement files and letters of recommendation, by making an appointment with the Superintendent, or designee. A representative of the Association may, at the Teacher's request, accompany the Teacher in this review.
I. Any Teacher suffering a bodily injury or occupational related illness during the individual's established working hours, must report the same to the teacher's building Principal in order that the request for coverage under the Worker's Compensation Act will be initiated.
J. Teachers will discipline students utilizing the Student Code of Conduct adopted by the Board.
K. Each Teacher must have a currently valid State of Michigan teaching certificate recorded in the Personnel Office for the current school year by November 1.
L. The Teacher must, at the request of the County Nurse, produce evidence of freedom from communicable diseases.

TEACHER RIGHTS AND RESPONSIBILITIES. (A) Teachers will not be required to perform any duty or act which threatens anyone's physical safety or well-being.
(B) All rules and regulations governing employee activities and conduct shall be interpreted and applied uniformly throughout the District.
(C) No personal religious or personal political philosophies shall be taught in the classroom.
TEACHER RIGHTS AND RESPONSIBILITIES. 3.9.1 Any member of the bargaining unit who is being reprimanded in writing or disciplined for any reason shall be entitled to have a representative of the Association in attendance at any conference scheduled for the above reason. If the delay in securing Association representation would not be in the immediate best interests of the school district, its pupils, and/or employees, the reprimand and/or discipline may be imposed without representation to the extent necessary to meet these immediate best interests.
3.9.2 Teachers shall be free to publish professional works or secure copyrights so long as such works have not been done under the auspices of the school system and/or as a part of their employment.
3.9.3 The Board, the Association, and the members of the bargaining unit shall carry out their respective functions without regard to any protected class status under state and federal law, including but not limited to race, religion, age, sex, marital status, color, national origin, creed, and membership or nonmembership in the Association. No reprisals shall be taken against any teacher by reason of his/her utilization of any procedure or right accorded by this Agreement, nor on account of his/her membership or position in the Association.
3.9.4 In the event a teacher secures non-school employment concurrently with the exercise of responsibilities under this Agreement and any other employment agreement with the Board, such non-school employment shall not conflict with contracted and professional responsibilities of the school district.
3.9.5 In matters not subject to the grievance procedure, teachers shall have the unrestricted right to use the judicial process when they believe their rights provided by law have been violated; teachers shall comply with all applicable federal, state, and municipal governments' statutes, laws, and ordinances.
3.9.6 Teachers shall accept their responsibility to practice their profession according to the highest professional ethical standards.
3.9.7 The teacher shall make reasonable effort to protect students from conditions harmful to learning or to health and safety. To assist the teacher in ensuring student safety, the district will consider the class structure and physical limitations of the facilities when planning schedules. No teacher shall be unreasonably required to risk harm or injury in the performance of his/her duties.

B. C. Agreement Rights in Addition to Legal Rights Nothing contained in this Agreement shall be construed to deny or restrict to any teacher the rights he/she may have under the Michigan Revised School Code, Tenure Act, or other applicable laws and regulations. D. Identification of Association Membership No teacher shall be prevented from wearing insignia, pins or other identification of membership in the Association either on or off school premises.
E. Official Personnel File The official personnel file shall be maintained at the Superintendent's Office. Materials kept in building files are official only if copies of materials therein contained are forwarded to the teacher and to the Superintendent for inclusion in the official files at the time they are placed in the Building file. Teachers shall have the right to a copy of any materials included in such file.
F. Right to Review Personnel File Teachers shall have the right, upon request, to review the contents of their own personnel file. A representative of the Association may be requested to accompany the instructor to such review. Confidential credentials (and related personal references) normally obtained at the time of employment are specifically exempted from such review and shall be removed prior to the review of the file. A teacher will be given the opportunity to file a response to any adverse material placed in the personnel file and the response shall be made a part of the said file.
