House Accounts. Excluded from commissions payable for sales in the non-exclusive Territory/Accounts are sales to the following House Accounts: No exclusions
House Accounts. In some instances the Territory and/or Distribution Channels may include retailers who have been engaged by Crocs as international "in house accounts ("House Accounts"). As of the Effective Date Crocs is not shipping to any House Accounts within the Territory. Accounts that originate in the Territory shall not qualify as House Accounts. In the event a House Account requests shipments be sent into the Territory, Crocs agrees to notify Distributor within thirty (30) days of its first such shipment. For such accounts, Crocs agrees to pay Distributor a seven percent (7%) commission of gross sales on all orders shipped into the territory by Crocs. Crocs shall supply Distributor with a quarterly accounting of any shipments made into the Territory by Crocs pursuant to a House Account. Such commission shall also apply to orders shipped into the Territory by the House Account customer, provided such orders can be quantified by Crocs using commercially reasonable efforts and inquiries. Commissions on House Accounts shall be paid to Distributor on a quarterly basis.
House Accounts. There are no “House” accounts or “Direct” accounts within the Territory unless designated as such in an attachment to this Agreement. Upon execution of this Agreement, no such accounts may be designated without the prior written consent of Representative.
House Accounts. As of the Effective Date, Cadence agrees not to distribute the Licensed Work(s) to the following accounts on a worldwide basis, except that Cadence may distribute to an account if a written quote has already been issued to such an account as of the Effective Date and a purchase order is received by the end of Cadence's fourth fiscal quarter of 1999. Nothing herein shall restrict Cadence's ability to sell products other than Licensed Works and provide maintenance and support to the following accounts. The parties agree to revise and negotiate in good faith the following list on an annual basis.
House Accounts. The term "House Accounts" means the existing -------------- -------------- customers of OPEN MARKET as of the Effective Date with facilities located in the Territory, to which Distributor shall be authorized to market and distribute the Software, only on condition that such software be purchased and physically located within the territory. All such House Accounts are designated on Exhibit ------- C. - ----------------------- Confidential treatment has been requested for portions of this exhibit. The copy filed herewith omits the information subject to the confidentiality request. Omissions are designated as *****. A complete version of this exhibit has been filed separately with the Securities and Exchange Commission.
House Accounts. Ameritech reserves the right to identify certain accounts as "House Accounts", and AD is not authorized to, and shall not Distribute Products to such accounts. A list of House Accounts is set forth under Exhibit F of this Agreement, incorporated by reference herein, and Ameritech, at its sole discretion, may modify Exhibit F from time-to-time via the "xxxxxxxxxxxxxxx.xxx" web site and bulletin board, and each modification will be deemed incorporated herein as if originally set forth herein, and the modification shall be effective on the date the modification is posted on the web site and bulletin board.
House Accounts. “House Accounts” are defined as the following persons or organizations who hired Artist to provide Advertising Photography prior to the date of this agreement: . During the first year of this agreement Artist shall pay Agent a commission equal to fifteen (15%) of the Revenue, as herein defined, received by Artist from House Accounts. During all subsequent years this agreement remains in force, Artist shall pay Agent a commission on House Accounts at the rate stated in Section 12 of this agreement. Agent shall at all times manage Artist’s business relationship with House Accounts exactly as Agent manages Artist’s business relationship with Artist’s other clients.
House Accounts. AD is not granted the right to Distribute Products to accounts identified by Ameritech as House Accounts. AD will be provided a list of House Accounts from time-to-time, and Ameritech may amend such list in its sole discretion. AD will have ninety (90) days from the date an account is designated by Ameritech as a House Account to close all pending sales activity. AD will not be awarded commission on any sale made to a House Account after ninety (90) days from the date the account is so designated. Ameritech shall notify AD of House Account designation according to Annex F hereunder ("Notice").
House Accounts. 7.1 For House Accounts, CORE will receive (35%) Thirty-Five per cent of the Royalty Fee instead of the regular (25%) Twenty-Five per cent royalty fee and this will apply to all Dealers included in the territory of the House Account including the Dealer that signs up the House Account.
House Accounts. The term "House Account" shall mean the existing or -------------- prospective customers of Proton identified on Exhibit C hereto, as amended from time to time. Proton shall have the right to add customers to the list of House Accounts at any time and from time to time upon written notice to Distributor.
