House Accounts. Excluded from commissions payable for sales in the Territory are sales to the following House Accounts:
House Accounts. As of the Effective Date, Cadence agrees not to distribute the Licensed Work(s) to the following accounts on a worldwide basis, except that Cadence may distribute to an account if a written quote has already been issued to such an account as of the Effective Date and a purchase order is received by the end of Cadence's fourth fiscal quarter of 1999. Nothing herein shall restrict Cadence's ability to sell products other than Licensed Works and provide maintenance and support to the following accounts. The parties agree to revise and negotiate in good faith the following list on an annual basis.
House Accounts. In some instances the Territory and/or Distribution Channels may include retailers who have been engaged by Crocs as international "in house accounts ("House Accounts"). As of the Effective Date Crocs is not shipping to any House Accounts within the Territory. Accounts that originate in the Territory shall not qualify as House Accounts. In the event a House Account requests shipments be sent into the Territory, Crocs agrees to notify Distributor within thirty (30) days of its first such shipment. For such accounts, Crocs agrees to pay Distributor a seven percent (7%) commission of gross sales on all orders shipped into the territory by Crocs. Crocs shall supply Distributor with a quarterly accounting of any shipments made into the Territory by Crocs pursuant to a House Account. Such commission shall also apply to orders shipped into the Territory by the House Account customer, provided such orders can be quantified by Crocs using commercially reasonable efforts and inquiries. Commissions on House Accounts shall be paid to Distributor on a quarterly basis.
House Accounts. The term "House Accounts" means the existing -------------- -------------- customers of OPEN MARKET as of the Effective Date with facilities located in the Territory, to which Distributor shall be authorized to market and distribute the Software, only on condition that such software be purchased and physically located within the territory. All such House Accounts are designated on Exhibit ------- C. - ----------------------- Confidential treatment has been requested for portions of this exhibit. The copy filed herewith omits the information subject to the confidentiality request. Omissions are designated as *****. A complete version of this exhibit has been filed separately with the Securities and Exchange Commission.
House Accounts. There are no “House” accounts or “Direct” accounts within the Territory unless designated as such in an attachment to this Agreement. Upon execution of this Agreement, no such accounts may be designated without the prior written consent of Representative.
House Accounts. Pursuant to Article 1, Section 1.7, the Customer accounts which Ameritech designates, in its sole discretion, as "House Accounts" are listed on the web site "xxxxxxxxxxxxxxx.xxx", and said list is incorporated by reference as if set forth fully herein, as modified from time-to-time by Ameritech, and each such modification is deemed incorporated as if set forth originally herein.
House Accounts. The term "House Account" shall mean the existing or -------------- prospective customers of Proton identified on Exhibit C hereto, as amended from time to time. Proton shall have the right to add customers to the list of House Accounts at any time and from time to time upon written notice to Distributor.
House Accounts. As listed in Schedule C, House Accounts are customers which Sipex, at its sole discretion, will not pay Representative any commission whatsoever. Sipex shall have the right to modify this list of House Accounts, at its sole discretion, by giving Representative thirty (30) days notice of such change.
House Accounts. Starry shall provide 55 Internet outlet(s) for Association’s use at the Property at no charge to Association together with 55 Starry Wi-Fi router(s) for Association’s use in connection with such outlets. Association agrees to be bound by the terms and conditions of the Starry Customer Agreement and to return the Starry Station(s) within 10 days of the expiration or termination of this Agreement.
House Accounts. 7.1 For House Accounts, CORE will receive (35%) Thirty-Five per cent of the Royalty Fee instead of the regular (25%) Twenty-Five per cent royalty fee and this will apply to all Dealers included in the territory of the House Account including the Dealer that signs up the House Account.
7.2 When a Dealer signs up a House Account, the Dealer will receive (10%) Ten percent of all transactional revenue derived from House Accounts (including revenue from the Territory of the Dealer that signs up the House Account) for a period of three years commencing from the date of execution of the House Account agreement. This will be additional to the Dealer's (65%) Sixty-Five per cent share of the Transaction Fee after taking into consideration section 7.1.
