Common use of Hydro Indemnity Clause in Contracts

Hydro Indemnity. If the conditions outlined in paragraph 9.2.12 (b) of this Article exist, or if the Capital is repaid to Hydro pursuant to subsection 9.2.12 of this Article, then Hydro shall indemnify Canada and Manitoba with respect to any damages that may be awarded against either of them, by a court of competent jurisdiction, or the arbitrator appointed pursuant to the NFA, with respect to any loss or damage suffered by any Member, Split Lake Cree Based Business, or Controlled Institution as a result of Adverse Effects on Split Lake Cree Assets. This indemnity is not intended to cover the costs of the indemnified Party in resisting such claim, and is conditional upon the indemnified Party:
