Common use of IDEA Clause in Contracts

IDEA. The School District/Charter School confirms the existence of policies and procedures regarding all aspects of the Uniform Grant Guidance (UGG), especially in the areas of conflict of interest, travel reimbursements, cash management, allow ability of costs and procurement. The School District/Charter School agrees that all procurement procedures reflect all Federal, State and Local procurement regulations and that sufficient documentation is maintained by the School District/Charter School to support all purchases made with these IDEA funds. Pursuant to 20 U.S.C. § 1413(g), the School District /Charter School hereby agrees and acknowledges, and shall have each subgrantee agree and acknowledge in its subaward agreement with the School District /Charter School that the PA Department of Education and/or the MCIU may at any time, and within its sole discretion, withhold or redirect any of the funding awarded hereunder in order for PDE and/or MCIU to fund any actual or anticipated special education or related services that PDE and/or MCIU determines are appropriate for any students of the School District /Charter School or subgrantee, including, without limitation, any entitlement to compensatory education ordered by a tribunal of competent jurisdiction or agreed to in any settlement agreement entered into by any subgrantee.
