Common use of IEP TEAM MEETINGS Clause in Contracts

IEP TEAM MEETINGS. An IEP team meeting shall be convened at least annually to evaluate the educational progress of each student placed with CONTRACTOR. Each LEA student shall be allowed to provide confidential input to any representative of his or her IEP team. Except as otherwise provided in the Master Contract, CONTRACTOR and XXX shall participate in all IEP team meetings regarding LEA students for whom ISAs have been or may be executed. At any time during the term of this Master Contract, the parent, the CONTRACTOR or the LEA may request a review of the student’s IEP, subject to all procedural safeguards required by law, including reasonable notice given to, and participation of, the CONTRACTOR in the meeting. Every effort shall be made to schedule IEP team meetings at a time and place that is mutually convenient to parent, CONTRACTOR and LEA. CONTRACTOR shall provide to LEA assessments and written assessment reports by service providers upon request and/or pursuant to LEA policy and procedures. It is understood that attendance at an IEP meeting is part of CONTRACTOR’S professional responsibility and is not a billable service under this Master Contract unless otherwise agreed on in writing by the LEA. It is understood that the CONTRACTOR shall utilize the approved electronic IEP system of the LEA such as the Special Education Information System (SEIS) for all IEP planning and progress reporting. The SELPA shall provide training for any NPA to assure access to THE APPROVED SYSTEM. The NPA shall maintain confidentiality of all IEP data on THE APPROVED SYSTEM and shall protect the password requirements of the system. When a student disenrolls from the NPA, the NPA shall discontinue use of THE APPROVED SYSTEM for that student. Changes in any LEA student’s educational program, including instruction, services, or instructional setting, provided under this Master Contract may only be made on the basis of revisions to the student’s IEP. In the event that the CONTRACTOR believes the student requires a change of placement, the CONTRACTOR may request a review of the student’s IEP for the purposes of consideration of a change in the student’s placement. Student is entitled to remain in the last agreed upon and implemented placement unless parent agrees otherwise or an interim alternative educational placement is deemed lawful and appropriate by LEA or OAH.

The NPA CONTRACTOR shall maintain confidentiality of all IEP data on THE APPROVED SYSTEM and shall protect the password requirements of the system. When a student disenrolls or ceases receiving services pursuant to this Agreement from the NPACONTRACTOR, the NPA CONTRACTOR shall discontinue use of THE APPROVED SYSTEM for that studentstudent unless otherwise asked to do so by LEA. Changes in any LEA student’s educational program, including instruction, services, or instructional setting, provided under this Master Contract Agreement may only be made on the basis of revisions to the student’s IEP. In the event that the CONTRACTOR believes the student requires a change of placement, the CONTRACTOR may request a review of the student’s IEP for the purposes of consideration of a change in the student’s placement. Except as otherwise provided specified in the Master Contractthis Agreement or by mutual agreement of both Parties, CONTRACTOR TPL, through an employee and/or subcontractor at its sole discretion, and XXX GUSD-PP shall participate in all IEP lEP team meetings regarding LEA GUSD-PP students for to whom ISAs have been or may be executedTPL is providing treatment. At any time during the term of this Master ContractAgreement, the student’s parent/guardian, the CONTRACTOR TPL, or the LEA GUSD-PP may request a review of the student’s IEP, subject to all procedural safeguards required by law, including reasonable notice given to, and to TPL to ensure participation of, the CONTRACTOR of a TPL-appointed employee and/or subcontractor in the meeting. Every effort shall be made to schedule IEP team meetings at a time and place that is mutually convenient to the parent/guardian, CONTRACTOR TPL, and LEAGUSD-PP. CONTRACTOR TPL, through an employee and/or subcontractor at its sole discretion, may attend IEP team meetings by phone or videoconference. TPL shall provide to LEA GUSD-PP assessments and written assessment reports by service providers upon request and/or pursuant to LEA policy GUSD-PP policies and procedures. It is understood that attendance at an IEP meeting or any other mandated meeting hosted by GUSD- PP is part of CONTRACTOR’S professional responsibility and is not a billable service to GUSD-PP under this Master Contract unless otherwise agreed on in writing by the LEAAgreement. It is also understood that the CONTRACTOR TPL shall utilize the approved electronic IEP system of the LEA such as the Special Education Information System (SEIS) GUSD-PP for all IEP lEP planning and progress reporting. The SELPA If needed, GUSD-PP shall provide training for any NPA TPL to assure ensure access to THE APPROVED SYSTEMthe approved system. The NPA TPL shall maintain confidentiality of all IEP lEP data on THE APPROVED SYSTEM the approved system and shall protect the password requirements of the system. When a student disenrolls or ceases receiving services from the NPATPL pursuant to this Agreement, the NPA TPL shall discontinue use of THE APPROVED SYSTEM the approved system for that studentstudent unless otherwise asked to do so by GUSD-PP. Changes in any LEA GUSD-PP student’s educational program, —including instruction, services, or instructional setting, —provided under this Master Contract Agreement may only be made only on the basis of revisions to the student’s IEP. In the event that the CONTRACTOR TPL believes the student requires a change of placementin service, the CONTRACTOR TPL may request a review of the student’s IEP for the purposes of consideration of a change in the student’s placement.
