Implementation of Investment. The City acknowledges that the Initial Owner has substantially completed the Public Improvements, as described in Paragraph 1(b) as of the Effective Date as evidenced by written confirmation by the City’s Public Works Department to the effect that the Public Improvements were carried out and constructed based on plans approved by the City, in accordance with this Agreement and in accordance with all applicable laws and regulations. The parties recognize that the substantial completion of the investment commitments identified in Paragraph 1(c) are material inducements for the City’s financial participation in the Project set forth in Paragraph 2(a) and Paragraph 2(d).
