Common use of Incidental Costs Clause in Contracts

Incidental Costs. Contractor shall bear the sole expense of all costs to mitigate any harmful effect, of any breaches or security incidents of which Contractor has knowledge which are directly caused by the use or disclosure of protected health information by Contractor in violation of the terms of this Agreement. These costs will include, but are not limited to, the cost of investigation, remediation and assistance to the affected individuals, entities or other authorities.
