Indemnification; Bodily Injury and Property Damage Insurance. 3.5.1 The Borrower shall defend, release, indemnify and hold harmless the City and its officers, employees agents and contractors from any claim, suit, liability, or judgment arising out of bodily injury or property damage resulting from, arising out of, or in any way connected with, the performance of this Agreement (including but not limited to the Acquisition, Pre-development or Construction or any of the Borrower’s activities hereunder) by the Borrower, whether such activities or performance thereof be by the Borrower or anyone directly or indirectly employed or contracted with the Borrower and whether such damage shall accrue or be discovered before or after termination of this Agreement.
