INSPECTION OF WORK ELEMENTS. The inspection of work elements for acceptance shall be a joint endeavor of the Government and the Contractor. Inspections will be conducted simultaneously, when possible, by both the Contracting Officer's Representative and a Contractor representative to facilitate mutual agreement on satisfactory contractual performance. The Contractor is responsible for contract performance and therefore shall provide quality control to ensure contract compliance and energy conservation performance where performing Operation and Maintenance Services. The Contracting Officer is responsible for final acceptance of all work. Acceptance shall be final and conclusive except for latent defects, fraud, gross mistakes amounting to fraud, and the Government’s rights under any warranty or guarantee.
