Interaction With Homestead Rights. Xxxxxxx XXX, §00 of the Texas Constitution provides that the homestead shall not be partitioned among the heirs of the deceased during the lifetime of the surviving husband or wife, or so long as the survivor may elect to use or occupy the same as a homestead; such provision is sometimes referred to as the “probate homestead.” Xxxxxxxx, 569 S.W.2d at 869. The homestead right of the survivor has been held to be one in the nature of a legal life estate or life estate created by operation of law. Id. Such rights, provided by law for the protection of the family and to secure a home for the surviving spouse, may be waived, however, particularly where, in the absence of any suggestion of fraud, overreaching or lack of understanding, (1) the parties to a premarital agreement are mature individuals, (2) full disclosure is made of the nature and extent of the property interest involved, (3) both parties have substantial separate property which they desire to preserve for themselves, and (4) there are no interests of any minor children to protect. Id. at 869-870; but see, Hunter x. Xxxxx, 687 S.W.2d 811, 817 (Tex.App.-San Antonio 1985, no writ) (premarital agreement was not a basis for establishing that the surviving spouse waived his right to elect to remain on homestead premises, which was the separate property of the deceased spouse, where the agreement contained no words such as “free from any claim” that might arise as the result of the marriage and, even if there were such words, there was no proof that the surviving spouse gave informed consent).

  • Interaction with Other Leaves Paid parental leave will run concurrently with any unpaid leave(s) that parents may be entitled to under other provisions of this Agreement or provided by law. Employees shall not receive other types of paid leave provided by this Agreement (e.g., sick, vacation, compensatory time) for hours for which they are receiving PPL.

  • Interaction with Other Leave Entitlements (a) An employee proceeding on unpaid Maternity Leave may elect to substitute any part of that leave with accrued annual and/or accrued long service leave.

  • Third Party Interactions During use of the Service, Subscriber may enter into correspondence with, purchase goods and/or services from, or participate in promotions of advertisers or sponsors showing their goods and/or services through the Service. Any such activity, and any terms, conditions, warranties, or representations associated with such activity, is solely between Subscriber and the applicable third party. TOMIS and its licensors shall have no liability, obligation, or responsibility for any such correspondence, purchase, or promotion between Subscriber and any such third party. TOMIS does not endorse any sites on the Internet that are linked through the Service. TOMIS provides these links to Subscriber only as a matter of convenience, and in no event shall TOMIS or its licensors be responsible for any content, products, services, or other materials on or available from such sites.   • Cooperation with Inspector General Grantee understands its duty, pursuant to Section 20.055(5), Fla. Stat., to cooperate with Florida Housing’s Inspector General in any investigation, audit, inspection, review, or hearing. Grantee will comply with this duty and ensure that any contracts issued under this Agreement impose this requirement, in writing, on its subcontractors.

  • Program Interactions with Other HFA Programs Other HFA program benefits may be available to the homeowner provided the HHF program maximum benefit cap of $100,000 has not been exceeded, and program funds are available. The homeowner is required to apply separately for each HFA program.

  • HABILITATIVE SERVICES (HABILITATIVE mean healthcare services that help a person keep, learn, or improve skills and functioning for daily living. Examples include therapy for a child who is not walking or talking at the expected age. These services may include physical and occupational therapy, speech therapy and other services performed in a variety of inpatient and/or outpatient settings for people with disabilities. HOSPITAL means a facility: • that provides medical and surgical care for patients who have acute illnesses or injuries; and • is either listed as a hospital by the American Hospital Association (AHA) or accredited by the Joint Commission on Accreditation of Healthcare Organizations (JCAHO).

  • Sharing Information with Billers You authorize us to share identifying personal information about you (such as name, address, telephone number, Xxxxxx account number) with companies that you have identified as your Billers and which we have identified as offering electronic bills for purposes of matching your identity on the Service’s records and the Xxxxxx’x records to (a) activate your affirmative request for electronic bills, and/or (b) confirm your eligibility for “trial basis” electronic bills.

  • COMMUNICATIONS BETWEEN THE PARTIES A copy of all communications relating to the subject matter of this Agreement between the Issuer and any Paying Agent (other than the Agent) shall be sent to the Agent.
