Common use of Internet Warnings Clause in Contracts

Internet Warnings. For purposes of compliance with subsection 2.3 and 2.6, if after May 6, 2021, Swpeet offers for sale any units of the Product via the internet: (i) to customers that directly, or indirectly through other entities that Swpeet has reason to believe, sell to downstream persons in California; or (ii) to consumers in California, Swpeet shall provide warnings for each unit of the Product both on the Product Label, and by prominently displaying the warning to the customer prior to completing the purchase or during the purchase of the Product without requiring the potential purchasers to seek out the warning. The warning (or a clearly marked hyperlink to the warning using the word “WARNING”) given in conjunction with the sale of the Product via the internet shall appear either: (a) prominently placed on the Product’s display page; (b) on the same web page as the order form for the Product; or (c) on one or more web pages displayed to a purchaser during the checkout process. The Settling Entity may also place the symbol “” adjacent to “WARNING.” The internet warning may use the Short-Form Warning content described in subsection 2.3(b) if the warning provided on the Product Label also uses the Short- Form Warning content.

The warning (or a clearly marked hyperlink to the warning using the word “WARNING”) ” and the symbol given in conjunction with the sale of the Product via the internet shall appear either: (a) prominently placed on the Product’s display pagesame web page on which the Product is displayed; (b) on the same web page as the order form for the Product; or (c) on one or more web pages displayed to a purchaser during the checkout process. For purposes of compliance with subsection 2.3 and 2.6If, if after May 6the Effective Date, 2021, Swpeet offers for sale any units of the Product Doremo sells Products via the internet: (i) , through its own website, affiliated websites or a third party website, to consumers located in California or to customers that directlywith nationwide distribution and e-commerce websites, or indirectly through other entities that Swpeet has reason to believe, sell to downstream persons in California; or (ii) to consumers in California, Swpeet Doremo shall provide warnings for each unit of the Product both on the Product Labellabel in accordance with Section 2.4, and by prominently displaying displaying, or requiring the warning to be prominently displayed on affiliated websites, third party websites or by retail customers, to the customer prior to completing the purchase or consumer during the purchase of the Product Products without requiring the potential purchasers customers to seek out the warning. The warning (or a clearly marked hyperlink to the warning using the word “WARNING”) ” given in conjunction with the sale of the Product Products via the internet shall appear either: (a) prominently placed on the Product’s display pagesame web page on which the Products are displayed; (b) on the same web page as the order form virtual cart displaying the Products; (c) on the same page as the price for the ProductProducts; or (cd) on one or more web pages displayed to a purchaser during the checkout process. The warning (or a clearly marked hyperlink to the warning using the word “WARNING”) Warnings given in conjunction with the sale of the Product Products via the internet shall appear either: (a) prominently placed on the Product’s display pagesame web page on which the Product is displayed; (b) on the same web page as the order form for the Product; or (c) on one or more web pages displayed to a purchaser during the checkout process. The Settling Entity may also place warning shall appear in any of the symbol “” above instances adjacent to “WARNING.” or immediately following the display or description of the Product for which it is given in the same type size or larger than the Product description text. The internet warning may use the Short-Form Warning content described in subsection Section 2.3(b) if the warning provided on the Product Label label also uses the Short- Short-Form Warning content. Gartner may also comply with this Section by providing the warning using a clearly marked hyperlink that includes the word “WARNING” on the same web page and in the same location as the display and/or description of the Product.

The warning (or a clearly marked hyperlink to the warning using the word “WARNING”) ” given in conjunction with the sale of the Product Products via the internet shall appear either: (a) prominently placed on the Product’s display pagesame web page on which the Products are displayed; (b) on the same web page as the order form virtual cart displaying the Products; (c) on the same page as the price for the ProductProducts; or (cd) on one or more web pages displayed to a purchaser during the checkout process.
