Common use of IRO Engagement Clause in Contracts

IRO Engagement. Rotech shall engage an IRO that possesses the qualifications set forth in Paragraph B, below, to perform the responsibilities in Paragraph C, below. The IRO shall conduct the review in a professionally independent and objective fashion, as set forth in Paragraph D. Within 30 days after OIG receives written notice of the identity of the selected IRO, OIG will notify Rotech if the IRO is unacceptable. Absent notification from OIG that the IRO is unacceptable, Rotech may continue to engage the IRO. If Rotech engages a new IRO during the term of the CIA, this IRO shall also meet the requirements of this Appendix. If a new IRO is engaged, Rotech shall submit the information identified in Section V.A.8 of the CIA to OIG within 30 days of engagement of the IRO. Within 30 days after OIG receives written notice of the identity of the selected IRO, OIG will notify Rotech if the IRO is unacceptable. Absent notification from OIG that the IRO is unacceptable, Rotech may continue to engage the IRO.

IRO Engagement. Rotech InterMune shall engage an IRO that possesses the qualifications set forth in Paragraph B, below, to perform the responsibilities in Paragraph C, below. The IRO shall conduct the review in a professionally independent and and/or objective fashion, as set forth in Paragraph D. Within 30 days after OIG receives written notice of the identity of the selected IRO, OIG will notify Rotech InterMune if the IRO is unacceptable. Absent notification from OIG that the IRO is unacceptable, Rotech InterMune may continue to engage the IRO. If Rotech InterMune engages a new IRO during the term of the CIA, this IRO shall also meet the requirements of this Appendix. If a new IRO is engaged, Rotech InterMune shall submit the information identified in Section V.A.8 of the CIA V.A.9 to OIG within 30 days of engagement of the IRO. Within 30 days after OIG receives written notice of the identity of the selected IRO, OIG will notify Rotech InterMune ‘if the IRO is unacceptable. Absent notification from OIG that the IRO is unacceptable, Rotech InterMune may continue to engage the IRO.

IRO Engagement. Rotech Medco shall engage an IRO that possesses the qualifications set forth in Paragraph B, below, to perform the responsibilities in Paragraph C, below. The IRO shall conduct the review in a professionally independent and and/or objective fashion, as set forth in Paragraph D. Within 30 thirty (30) days after OIG receives written notice of the identity of the selected IRO, OIG will notify Rotech Medco if the IRO is unacceptable. Absent notification from OIG that the IRO is unacceptable, Rotech Medco may continue to engage the IRO. If Rotech Medco engages a new IRO during the term of the CIA, this IRO shall also meet the requirements of this Appendix. If a new IRO is engaged, Rotech Medco shall submit the information identified in Section V.A.8 of the CIA to OIG within 30 days of engagement of the IRO. Within 30 days after OIG receives written notice of the identity of the selected IRO, OIG will notify Rotech Medco if the IRO is unacceptable. Absent notification from OIG that the IRO is unacceptable, Rotech Medco may continue to engage the IRO.

IRO Engagement. Rotech Elan shall engage an IRO that possesses the qualifications set forth in Paragraph B, below, to perform the responsibilities in Paragraph C, below. The IRO shall conduct the review in a professionally independent and objective fashion, as set forth in Paragraph D. Within 30 days after OIG receives written notice the information identified in Sections V.A.10 and V.A.11 of the identity of the selected IROCIA, OIG will notify Rotech Elan if the IRO is unacceptable. Absent notification from OIG that the IRO is unacceptable, Rotech Elan may continue to engage the IRO. If Rotech Elan engages a new IRO during the term of the CIA, this IRO shall also meet the requirements of this Appendix. If a new IRO is engaged, Rotech Elan shall submit the information identified in Section V.A.8 Sections V.A.10 and V.A.11 of the CIA to OIG within 30 days of engagement of the IRO. Within 30 days after OIG receives written notice of the identity of the selected IROthis information, OIG will notify Rotech Elan if the IRO is unacceptable. Absent notification from OIG that the IRO is unacceptable, Rotech Elan may continue to engage the IRO.

IRO Engagement. Rotech Allergan shall engage an IRO that possesses the qualifications set forth in Paragraph B, below, to perform the responsibilities in Paragraph C, below. The IRO shall conduct the review in a professionally independent and objective fashion, as set forth in Paragraph D. Within 30 days after OIG receives written notice of the identity of the selected IRO, OIG will notify Rotech Allergan if the IRO is unacceptable. Absent notification from OIG that the IRO is unacceptable, Rotech Allergan may continue to engage the IRO. If Rotech Allergan engages a new IRO during the term of the CIA, this IRO shall also meet the requirements of this Appendix. If a new IRO is engaged, Rotech Allergan shall submit the information identified in Section V.A.8 V.A.10 of the CIA to OIG within 30 days of engagement of the IRO. Within 30 days after OIG receives written notice of the identity of the selected IRO, OIG will notify Rotech Allergan if the IRO is unacceptable. Absent notification from OIG that the IRO is unacceptable, Rotech Allergan may continue to engage the IRO.

IRO Engagement. Rotech Cephalon shall engage an IRO that possesses the qualifications set forth in Paragraph B, below, to perform the responsibilities in Paragraph C, below. The IRO shall conduct the review in a professionally independent and objective fashion, as set forth in Paragraph D. Within 30 days after OIG receives written notice of the identity of the selected IRO, OIG will notify Rotech Cephalon if the IRO is unacceptable. Absent notification from OIG that the IRO is unacceptable, Rotech Cephalon may continue to engage the IRO. If Rotech Cephalon engages a new IRO during the term of the CIA, this IRO shall also meet the requirements of this Appendix. If a new IRO is engaged, Rotech Cephalon shall submit the information identified in Section V.A.8 V.A.10 of the CIA to OIG within 30 days of engagement of the IRO. Within 30 days after OIG receives written notice of the identity of the selected IRO, OIG will notify Rotech Cephalon if the IRO is unacceptable. Absent notification from OIG that the IRO is unacceptable, Rotech Cephalon may continue to engage the IRO.

IRO Engagement. Rotech Xxxxxx shall engage an IRO that possesses the qualifications set forth in Paragraph BC, belowof this Appendix, to perform the responsibilities in Paragraph CD, belowof this Appendix. The IRO shall conduct the review in a professionally independent and objective fashion, as set forth in Paragraph D. E, of this Appendix. Within 30 days after OIG receives written notice the information identified in Paragraph B, of the identity of the selected IROthis Appendix, OIG will notify Rotech Xxxxxx if the IRO is unacceptable. Absent notification from OIG that the IRO is unacceptable, Rotech Xxxxxx may continue to engage the IRO. If Rotech Xxxxxx engages a new IRO during the term of the CIA, this IRO shall also meet the requirements of this Appendix. If a new IRO is engaged, Rotech Xxxxxx shall submit the information identified in Section V.A.8 Paragraph B, of the CIA this Appendix, to OIG within 30 days of engagement of the IRO. Within 30 days after OIG receives written notice of the identity of the selected IROthis information, OIG will notify Rotech Xxxxxx if the IRO is unacceptable. Absent notification from OIG that the IRO is unacceptable, Rotech Xxxxxx may continue to engage the IRO.

IRO Engagement. Rotech HealthSouth shall engage an IRO that possesses the qualifications set forth in Paragraph B, below, to perform the responsibilities in Paragraph C, below. The IRO shall conduct the review in a professionally independent and and/or objective fashion, as set forth in Paragraph D. Within 30 days after OIG receives written notice of the identity of the selected IRO, OIG will notify Rotech HealthSouth if the IRO is unacceptable. Absent notification from OIG that the IRO is unacceptable, Rotech HealthSouth may continue to engage the IRO. If Rotech HealthSouth engages a new IRO during the term of the CIA, this IRO shall also meet the requirements of this Appendix. If a new IRO is engaged, Rotech HealthSouth shall submit the information identified in Section V.A.8 of the CIA to OIG within 30 days of engagement of the IRO. Within 30 days after OIG receives written notice of the identity of the selected IRO, OIG will notify Rotech HealthSouth if the IRO is unacceptable. Absent notification from OIG that the IRO is unacceptable, Rotech HealthSouth may continue to engage the IRO.

IRO Engagement. Rotech King shall engage an IRO that possesses the qualifications set forth in Paragraph B, below, to perform the responsibilities in Paragraph C, below. The IRO shall conduct the review in a professionally independent and and/or objective fashion, as set forth in Paragraph D. Within 30 days after OIG receives written notice of the identity of the selected IRO, OIG will notify Rotech King if the IRO is unacceptable. Absent notification from OIG that the IRO is unacceptable, Rotech King may continue to engage the IRO. If Rotech King engages a new IRO during the term of the CIA, this IRO shall also meet the requirements of this Appendix. Appendix A. If a new IRO is engaged, Rotech King shall submit the information identified in Section V.A.8 of the CIA to OIG within 30 days of engagement of the IRO. Within 30 days after OIG receives written notice of the identity of the selected IRO, OIG will notify Rotech King if the IRO is unacceptable. Absent notification from OIG that the IRO is unacceptable, Rotech King may continue to engage the IRO.

IRO Engagement. Rotech Zimmer shall engage an IRO that possesses the qualifications set forth in Paragraph B, below, to perform the responsibilities in Paragraph C, below. The IRO shall conduct the review in a professionally independent and objective fashion, as set forth in Paragraph D. Within 30 days after OIG receives written notice of the identity of the selected IRO, OIG will notify Rotech Zimmer if the IRO is unacceptable. Absent notification from OIG that the IRO is unacceptable, Rotech Zimmer may continue to engage the IRO. If Rotech Zimmer engages a new IRO during the term of the CIA, this IRO shall also meet the requirements of this Appendix. If a new IRO is engaged, Rotech Zimmer shall submit the information identified in Section V.A.8 of the CIA V.A.11 to OIG within 30 days of engagement of the IRO. Within 30 days after OIG receives written notice of the identity of the selected IRO, OIG will notify Rotech Zimmer if the IRO is unacceptable. Absent notification from OIG that the IRO is unacceptable, Rotech Zimmer may continue to engage the IRO.
