10.05 It 12.06 Vacancies of ninety (90) calendar days or less shall be offered to employees in the responsibility same classification and unit/home area on the basis of rotational seniority, who have requested additional hours in writing, and who are not scheduled to work on the day of the Employer vacancy. Under no circumstances shall the assignment of shifts under this provision result in overtime payment. JOB POSTING, HIRING AND TRANSFERS. a. 15.02 If a vacant position cannot be filled from employees who are employed, no new employee shall be hired until employees on layoff are given the opportunity of recall.
(a) An employee who wishes to be considered for the position so posted, shall sign their name and date in the space provided on the posting; if the employee is absent for a valid reason, she may indicate have her Union Representative post on her behalf. Employees who are absent may pre-apply to a specific job posting in writing to her immediate supervisor her interest in any posting that may occur during her absence. 12.07 Upon ratification by the Union in writing, the Home will give reasonable consideration to a request for a leave of absence, without pay, to an employee elected or appointed to a full-time position within the Union. The Employer shall be given a minimum of four (4) weeks notice of such request. It is understood that no more than one (1) employee in the bargaining unit may be on such leave at the same time. Such leave shall be for not more than one (1) calendar year from the date of appointment. Seniority shall accumulate for employees during such leave, on the basis of what his/her normal regular hours of work would have been. Service shall accumulate for employees during such leave to the maximum provided, if any, under the provisions of the Collective Agreement. It will become the responsibility of the Employer employee for full payment of any applicable benefits in which the employee is participating during such leave of absence. It is understood that the Home will not incur any costs related to staff this leave. The employee shall notify the Nursing Home in accordance with of his/her intention to return to work at least four (4) weeks prior to the standards set forth date of such return. The employee shall be returned to his/her former duties on the same shift in the Nursing same department and at the appropriate rate of pay, subject to any changes which would have occurred had the employee not been on leave. In either caseThe successful applicant shall not be entitled to bid for another posted vacancy for a period of four (4) months after the date of the successful application. It is understood that this will not apply to those employees filling temporary vacancies. 12.06 Any employee transferred outside the bargaining unit for up to one (1) year shall, if rehired to a job within the bargaining unit, be reinstated any seniority formerly accumulated as of the date of transfer as long as the employee has been continuously employed by the Employer while outside the bargaining unit.
12.07 Upon notice by the Union in writing, the Home will give reasonable consideration to a request for a leave of absence, without pay, to an employee elected or appointed to a full-time position within the Union. The Employer shall be given a minimum of four (4) weeks‟ notice of such request. It is understood that no more than one (1) employee in the bargaining unit may be on such leave at the same time. Such leave shall be for not more than one (1) calendar year from the date of appointment. Seniority shall accumulate for employees during such leave, on the basis of what his/her normal regular hours of work would have been. Service shall accumulate for employees during such leave to the maximum provided, if any, under the provisions of the Collective Agreement. It will become the responsibility of the Employer employee for full payment of any applicable benefits in which the employee is participating during such leave of absence. It is understood that the Home will not incur any costs related to staff this leave. The employee shall notify the Nursing Home in accordance with of his/her intention to return to work at least four (4) weeks prior to the standards set forth date of such return. The employee shall be returned to his/her former duties on the same shift in the Nursing same department and at the appropriate rate of pay, subject to any changes which would have occurred had the employee not been on leave.
