VACANCIES AND TRANSFERS. A vacancy shall be defined, for purposes of this Agreement, as a position previously held by a bargaining unit member that needs to be filled, or a newly created PSS position. When all necessary parties agree, vacancies can be filled by organizational advancement or transfer from within the hiring department and shall not require posting. All vacancies will be posted for a minimum of seven (7) working days unless filled by transfer, reassignment, or recall of a laid off staff member. Notice of vacancies will be given to the Alliance President and Chief Alliance ▇▇▇▇▇▇▇ at the time they are posted on the University's electronic Notices GVSU Business board, and will be simultaneously posted at the University’s electronic employment website. A vacancy will not be filled until after the posting period has expired. Job postings shall include the classification, department, location(s), work schedule and the position description. The search committee will include a PSS member. Typically, vacancies will be posted as an open search available for both internal and external applicants. A job posting limited to internal applicants may occur upon approval. In each instance, all qualified internal applicants will receive an interview. The search committee must present strong justification for not selecting an internal applicant who meets the minimum qualifications of the position. When two applicants are equally qualified for the vacant position, based on current position description and satisfactory work and attendance, the more senior qualified staff member will receive the assignment. At the time of job offer, the University shall notify the selected staff member of any known or impending changes in the position. The Human Resources Office, or their designee, will provide internal applicants not selected for the position with rationale for the decision. Candidates who were interviewed but not selected may contact Human Resources to schedule a meeting with the Search Committee Chairperson, a Human Resource representative, and an Alliance Representative to discuss the reason for non-selection. The Alliance must notify the employer within three (3) working days that the meeting has been the step 1 meeting of the grievance process. VACANCIES AND TRANSFERS. A. A vacancy is defined as a position currently unoccupied that has not been assigned and cannot be filled by a teacher returning from leave or a laid-off tenured teacher because they lack certification and qualification. When vacancies or new positions occur during the regular school year, the superintendent shall make a general announcement of the vacancy throughout the school system by posting position qualifications in all buildings. Such vacancy shall have been posted in a designated area within all buildings for a minimum of five (5) school days prior to filling the position. Between the end of the school year and August 15th of the next school term the Superintendent shall notify all teachers certified for the position by email of all vacancies and post in Administration Building. Such vacancy notices shall have been emailed two weeks prior to the filling of said position.
B. The Board recognizes that it is desirable in making assignments to consider the interests and aspirations of its teachers. Requests by a teacher for transfer to a different class, building, or position shall be made in writing, one copy of which shall be filed with the principal(s), the Superintendent, and one copy shall be filed with the Association. The application shall set forth the school, grade or position sought. Such requests shall be renewed once each year to assure active consideration by the Board.
C. An involuntary transfer will be made only in case of emergency or to prevent undue disruption of the instructional program. The Superintendent and/or principal shall notify the affected teacher in writing and the Association in writing of the reasons for such transfer. Such notification shall take place at least ten (10) school days prior to the scheduled transfer. If the teacher objects to such transfer for the reasons given, the dispute may be resolved through the professional grievance procedure. An involuntary transferred teacher shall have the right to: (1) return to his/her former grade or position when a vacancy occurs in that position; (2) request a transfer at the time of the involuntary transfer. Such transfer request shall indicate the position desired, i.e. ▇▇▇▇▇▇ sixth grade, high school math. No more than three positions may be listed. VACANCIES AND TRANSFERS. A. Whenever any vacancy in a professional position in the bargaining unit shall occur, the District will give written notice of the vacancy to the Association, including a general statement regarding the required qualifications for the position.
1. Any teacher may apply for such vacancy. In filling such vacancy, the District agrees to give due weight to the professional certification, professional experiences, whether the individual is “highly qualified” as described in the Elementary and Secondary Education Act and related background of all applicants and the length of time each has been in the Midland school system. Within a reasonable time after the notification of a vacancy, all applicants will be informed that the position has been filled, or the notification withdrawn.
2. A vacant position will not be filled, except on a temporary basis, within thirteen (13) calendar days from the date of notification to the Association.
3. When a vacancy occurs within the last thirteen (13) calendar days prior to the orientation day of a new school year, although the Association will be notified of this vacancy, the first priority must go to filling the position for the new school year. Therefore, the time limits imposed on the District in Article XVII, section, A.2. will not be applicable for this two-week period.
4. When a vacancy is filled in the period from thirteen (13) days prior to the orientation day of the new school year through November 1, it will be filled by hiring a teacher who will have all rights accorded all members of the bargaining unit except that the teacher may be reassigned at the beginning of the succeeding school year, solely at the discretion of the District, to any comparable position for which the teacher is certified. The language in Article XVII, 4. shall not apply when the vacancy occurs as the result of a retirement. The District may elect to fill a teaching vacancy by hiring a teacher at any point during the year.
5. When a vacancy occurs during a school year after November 1, the position may be filled on a temporary basis.
B. Although the District and the Association recognize that frequent transfers of teachers from one school administrative unit to another are disruptive of the educational process and interfere with optimum teacher performance, they also recognize that some transfers will be necessary for administrative purposes and to ensure a fair distribution of experienced and qualified teachers through the system. VACANCIES AND TRANSFERS. 9-01. All vacancies for assistant positions will be posted on the District’s website. All Assistant vacancies will be posted within the school system before or as soon as they are posted outside the school system. The posting will be dated and the position will not be filled until five (5) days after the posting of the notice.

9-04. Assistants who desire a change in assignment, or who desire to transfer to another building for the next school year, will file a written statement of such desire with the Office of the Superintendent. Such assignment may be made at the discretion of the Superintendent or designee.
9-05. If a position is eliminated or changed from category of IA to another category, the Superintendent or his designee will notify the Organization. Should circumstances warrant a change in assignment, every reasonable effort will be made by the Superintendent to transfer the Assistant to a position compatible with the former assignment unless it is determined that an assignment to another category would be a better match for student needs.
9-06. The Superintendent or his/her designee will consider end-of-year transfer requests before making assignments of new Assistants. System-wide seniority will be given serious consideration; however, the final decision regarding assignments rests with the Superintendent or designee. 9-07. Written acknowledgement will be forwarded to the assistant upon receipt of the request for reassignment and/or transfer.
9-08. Notice of assignment will be given to the Assistant, with a copy to the Organization, within ten (10) days of the granting of the Assistant’s request.
9-09. Each Assistant who applies for a new assignment to a particular position, but whose request is not granted, will be notified within ten (10) days of the date a decision is made, with a copy to the Organization.
9-10. When a reduction in the number of Assistants in a school is necessary, qualified volunteers for transfer will be considered. Vacancies and Voluntary Transfers Sec 9.1 Annually, prior to March 1, the District shall notify all employees of their right to request a transfer for the following school year. Employees who would like to request a transfer shall submit their interest to the personnel office by March 15; requests will be kept on file until March 15 of the following year.

All vacancies will be posted in the office of the transportation director and a copy to the Union President. Interested employees must apply in writing within the five (5) day posting period. If a bus run becomes vacant and two (2) or more employees are equally qualified as determined by the school administration, the employee with the most seniority will have first choice for the position. The location of the employee and the run will weigh heavily in the determinant of equally qualified but will not be the only determinant.
B. The Board shall provide notification of all school permanent vacancies by posting notice on the Union bulletin board. Interested applicants must apply in writing within the five (5) day posting period.
